In Re : Sk. Imtiaz @ Rahul
... Petitioner.
Mr. Mrityunjoy Chatterjee, Ms. Suchismita Chakraborty, Mr. Debarnab Adhikary
... For the Petitioner.
Mr. Subrata Mukherjee, Mr. Somnath Bera, Mr. Anirban Kumar Banerjee
... For the State.
Ms. Pragya Banerjee
... For the de facto complainant.
Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 4 years 10 months and other accused person has recently been granted bail. Learned advocate appearing for the de facto complainant opposes the prayer for bail. Learned advocate appearing for the State opposes the prayer for bail and produces the case diary. I have taken into account the order passed in CRM(M) 2625 of 2026 wherein an accused person in the present case has been granted bail only on the ground of long
2 incarceration. Having considered the same, I am of the opinion that the present petitioner viz., Sk. Imtiaz @ Rahul be released on bail by the learned Trial Court on the same terms and conditions as the other accused viz. Shahid Parvez who has been granted bail on 12.10.2026 in CRM (M) 2625 of 2026. Accordingly, the prayer for bail of the petitioner is allowed. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 2653 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
