The complainant has filed the present complaint alleging willful disobedience of the order dated 05.02.2025, passed by the learned Single Judge in WP.No.34818/2024 (KLR-RES). In terms of the said order, the concerned authorities were directed to act on the application filed by the complainant for conducting durasthi/survey and Phodi in respect of lands measuring 2 acres 19 guntas falling in Sy.No.197/P3 of Kudiyanur Village, Malur Taluk, Kolar District. 2. The accused has filed an affidavit indicating that subsequent to the said order, the Tahsildar has issued an intimation to the complainant for calling upon him to give the necessary documents. After verifying the documents and records available, it was noticed that in the recent RTC in Column No.10, MR.No.4/93-94 is reflected in respect of lands falling in Sy.No.197 of Kudiyanur Village, Maluru Taluk, Kolar District. However, on verification it was found that the said MR entry relates to a land falling in Sy.No.83/3 and not in respect to the land falling in Sy.No.197. Further, the said - 4 - HC-KAR NC: 2026:KHC:3912-DB CCC No. 936 of 2025 entry relates to one H.Muniyappa, S/o Hanumantappa and the entries have made pursuant to a sale deed dated 12.05.1971. 3. In view of the above, the phodi and durasthi as sought for by the complainant has not been done. 4. In view of the above, we are unable to accept that the accused is liable to be proceeded against for willful disobedience of the order dated 05.02.2025 in WP.No.3488/2024 (KLR-RES). 5. The complaint is accordingly closed. 6. We clarify that the complainant is not precluded from availing his remedies including in regard to the facts as narrated in the compliance affidavit and the endorsement issued to the complainant in respect of his representation.
