1. Mr. S.K. Pandey, learned counsel for the petitioner.
2. Mr. N.K. Papnoi, learned Standing Counsel for the State of Uttarakhand.
3. Petitioner was initially appointed in an unaided Higher Secondary School known as “Adarsh Inter College, Sanjay Nagar, Bindu Khatta, District Nainital” in the year 1992. The said Institution was included in the grant-in-aid list in 2007. Petitioner started receiving salary from State Exchequer from 2007, and he reached age of superannuation and retired in 2024.
4. In this writ petition, petitioner has sought the following reliefs: -
(i) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent authorities to fix the pay of the petitioner by counting his entire length of service from the date of initial appointment/ approval and not from the date when the institution was brought under grant- in-aid.
(ii) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent authorities to grant all consequential service and monetary benefits to the petitioner, including time-scale/ selection grade/ ACP benefits, arrears of salary and revision of pensionary benefits, along with interest.
(iii) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent authorities to comply with the letter/ order dated 28.12.2013 issued by the Finance Officer, School Education, Nainital, within a stipulated time frame.

5. Learned State Counsel submits that petitioner should have approached this Court immediately upon inclusion of the Institution in the grant-in-aid list and he should not have waited for nearly nineteen years for approaching this Court.
6. This Court finds substance in the said submission. The benefit, which petitioner is now seeking, could have been sought by him in the year 2007 or any subsequent year immediately thereafter. Petitioner has filed this writ petition, after lapse of more than eighteen years.

Learned counsel for the petitioner submits that petitioner may be permitted to make representation to the Competent Authority in the department for redressal of his grievance.
8. The writ petition is, accordingly,
disposed of with liberty to petitioner to make representation to the Competent Authority within ten days from today. If he makes representation within the stipulated time, decision thereupon shall be taken, as per law, within six months thereafter.
