This writ petition has been filed under Article 227 of the Constitution of India challenging the legality, judicial propriety and correctness of the impugned order dated 15.03.2021 passed by the learned 1st Civil Judge Class- II, Bemetara, District Bemetara (CG) in Civil Suit No. 51- A/ 2019, by which the application of the petitioners/ plaintiffs filed under Order 6 Rule 17 of CPC, was rejected. 2. Learned counsel for the petitioners submits that the petitioners who happen to be the plaintiffs, filed a civil suit for declaration of title, partition, separate possession and permanent injunction regarding the suit property described in the plaint. He submits that after the written statement of the plaint was filed, and in light of averments made therein, an application for amendment under Order 6 Rule 17 of CPC was moved to elaborate upon the factual scenario. By way of this amendment, the petitioners 4 sought to clarify in a specific paragraph that no partition whether registered or unregistered was ever executed by Bisesar, his wife Bhuri Bai and others. Although a brief recital of this fact exists in the original plaint, in order to elaborate the factual scenario, this amendment was made and it would not change the nature of the suit and is necessary for the adjudication of the dispute on its merits. However, the learned Civil Judge, vide the impugned order, rejected the said application only on the ground that the recital of the said amendment is already on record. Thus he submits that the impugned order may be set aside by allowing the application for amendment. 3. Opposing the submissions learned counsel for respondents support the impugned order submitting that although the recital was elaborated by way of amendment, the substance of the same was already present in the plaint, therefore, there was no necessity to incorporate the amendment. Thus, the impugned order does not suffer from any illegality or irregularity. 4. Heard learned counsel for the parties and perused the record. 5. Upon perusal of the application for amendment, it appears that the deceased Bisesar, his wife Bhuribai and the plaintiffs had not entered into any registered or unregistered partition. It has further been proposed, by way of amendment, that the respondents/ defendants are making false and fabricated statements alleging that Bisesar was given land in Village Mohtara under a partition. In the opinion of this Court, by allowing the said application, no prejudice would be caused to the respondents/ defendants who may file an application for consequential amendment to controvert the amendment so proposed. Thus, the impugned order is set aside and the application under Order 6 Rule 17 of the CPC is allowed. The petitioners/ plaintiffs are at liberty to amend the plaint on a date to be fixed by the learned Civil Judge. 6. Thus, the writ petition is allowed.
