No. 4 of 2022 in A.O.S No. 30 of 2020 on the file of the court of Learned Agency Subordinate Judge, Paderu, IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Pleased to dispense with filing of certified copy of Order Dt. 23.04.2022 passed in lA No, 4 of 2022 in AOS No. 30 of 2020 on the file of Agency Subordinate Judge, Paderu and to receive the main CRP on file, in the interests of justice and pass Counsel for the Petitioner:
1. SIVA SANKARA RAO BORRA Counsel for the Respondent(S):
1.
The Court made the following:
3
THE HONOURABLE SRI JUSTICE BATTU DEVANAND CIVIL REVISION PETITION No.1615 of 2026
ORDER: - The petitioner is the 2nd defendant in A.O.S.No.30 of 2020, on the file of the Agency Subordinate Judge, Paderu, filed by Respondent Nos.1 and 2 herein.
2. Along with the A.O.S. No.30 of 2020, Respondent Nos.1 and 2 herein, filed an application in I.A.No.4 of 2022 seeking temporary injunction in their favour against the suit schedule land.
3. The learned Agency Subordinate Judge, Paderu, by order dated 23.04.2022, directed the plaintiffs and defendants therein, to maintain status- quo, until further orders.
4. In the present civil revision petition, the petitioner contends that, though an interim order is passed in I.A.No.4 of 2022 on 23.04.2022, till now, even after the expiry of four years, the said interlocutory application in I.A.No.4 of 2022 is not disposed of and the Main AOS also not taken up for further proceedings.
5. Mr. Siva Sankara Rao Borra, learned counsel for the petitioner would submit that due to the inaction of the Court below in disposing of I.A.No.4 of 2022, for a long time, the petitioner is put to heavy loss and hardship and sought a direction to the learned Agency Subordinate Judge, Paderu, to dispose of A.O.S.No.30 of 2020 expeditiously, in the interest of justice.
4
6. Having considered the submissions of the learned counsel for the petitioner and upon careful examination of the material available on record, it is true that the learned Agency Subordinate Judge, Paderu, by order dated 23.04.2022 in I.A.No.4 of 2022 in A.O.S.No.30 of 2020, passed an interim
order directing the plaintiffs and defendants therein to maintain status-quo until further orders. The grievance of the petitioner is that, thereafter, the said I.A. is not disposed of and the main case also not taken up for consideration.
7. Considering the fact that the main case is of the year 2020 and I.A.No.4 of 2022 is pending for the last four years, in our considered view, it is appropriate and desirable to direct the learned Agency Subordinate Judge, Paderu, to dispose of A.O.S.No.30 of 2020 as expeditiously as possible, preferably within a period of three (03) months, to meet the interest of justice.
8. Accordingly, the Civil Revision Petition is disposed of with a direction to the learned Agency Subordinate Judge, Paderu, to dispose of A.O.S.No.30 of 2020 on its file, in accordance with law, as early as possible preferably within a period of three (03) months from the date of receipt of a copy of this order.
9. There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
