EASTERN COALFIELDS LIMITED AND ANR VS UNION OF INDIA AND ORS.
Ms. Priti Banerjee, Adv.
…for the petitioner
Mr. Sukanta Banerjee, Adv.
Mr. Rananjay Chatterjee, Adv.
…for Union of India
1. Affidavit of service filed be taken on record.
2. The writ application has been preferred challenging an award dated 26th December, 2025 passed by the learned Central Government Industrial Tribunal-cum- Labour Court, Asansol.
3. Vide the impugned award, the learned Tribunal, directed as follows:
“The Industrial Dispute is allowed on contest against the management of Bhanora West Block Colliery, ECL. This Industrial Distpute is decided in favour of union with a direction to the management to provide employment to Sunny Mejhan, the dependent daughter of Binodi Mejhan under the employer company by completing all procedural formalities within two months from the date of communication of this Award. Let copies of the Award in duplicate be sent to the Ministry of Labour, Government of India, New Delhi for information and Notification.”
4. On hearing the learned Counsel for the parties and on perusal of the materials on record, it appears that the employee in the present case died on 30.08.2009. As per rules the Apex Committee assessed the age of the claimant to be between 40-45 as on 31.08.2020.
2
5. Considering the age as assessed in the said report it goes to show that the claimant herein was aged about 29 years on the date of death of the employee i.e. on
30.08.2009.
6. Learned Counsel for the petitioner submits that the petitioner is to be aged within 35 years on the date of application to be eligible to be considered for compassionate appointment.
7. Admittedly the application for compassionate appointment was made on 24.05.2014. As such it appears that the claimant was aged less than 35 years on the date of application i.e. she was aged about 34 years plus and thus she was prima facie eligible for the compassionate appointment.
8. On hearing the parties and considering the well reasoned award passed by the learned tribunal, this Court finds no reason to interfere with the same.
9. The writ application stands dismissed.
10. There shall be no order as to costs.
11. Urgent Photostat certified copy of this order, if applied for, be given to the parties on an usual undertaking.
