Petitioner has filed this writ petition, seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ by quashing the order impugned dated 04.02.2026 (Annexure P/1) passed by the Under Secretary, Department of Planning, Economic and Statistics which relates to the Transfer of Services of the petitioner from the District Planning and Statistics Office, Rajnandgaon to the District Planning and Statistics Office, Kanker. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents to produce all the relevant records which relates to transfer of petitioner for kind perusal of this Hon’ble Court. 10.3 Any other relief, which this Hon’ble Court may deem fit and proper, may also be passed in favour of the petitioner together with cost of the petition.” 2. Learned counsel for petitioner submits that petitioner is holding the post of Assistant Statistical Officer and is posted at District Planning and Statistics Office, Rajnandgaon. He has been transferred to District Planning and Statistics Office, Kanker which is at considerate distance. Wife of petitioner is also a Government Servant and is working as a Training Officer at ITI, Rajnandgaon, sister of petitioner is also suffering with severe anemia and needs regular treatment. By the impugned order of transfer petitioner is transferred to schedule area where petitioner has already served for about 12 years till 2022 and therefore, transfer of petitioner again in schedule area is in contravention of policy formulated by the State Government dated 03.06.2015. He lastly submits that petitioner has already submitted representation which is pending consideration and therefore, direction be issued to concerned 3 / respondent authority to consider and take decision on representation submitted by petitioner. 3. Learned counsel for State opposes the submission made by learned counsel for petitioner and would submit that under the transfer policy State Government has constituted a committee to consider the grievances of employees against their transfer, but from the documents enclosed, it is not reflecting that petitioner has submitted any representation before the Committee so constituted. 4. At this stage, learned counsel for petitioner submits that petitioner was not aware with regard to the constitution of committee and therefore, he may be permitted to submit fresh representation/appeal before the committee constituted under the Transfer Policy and concerned committee be directed to consider and decide the representation at the earliest. He also submits that petitioner till date has not been relieved and no one has been posted at the place of petitioner. 5. Considering the nature of grievances raised by the petitioner in this writ petition, petitioner is permitted to submit representation before the Committee constituted under the Transfer Policy raising all the grounds as raised in this writ petition and if, petitioner submits such representation within a period of 10 days from today, the concerned committee shall consider and take decision on representation submitted by petitioner, in an objective manner, sympathetically within further period of 3 week’s from the date of receipt of the order. 6. Considering document Annexure P-7 which is discharge summary of Vibha Chandane who is stated to be sister of petitioner and she is diagnosed as suffering from severe Anemia and Neutropenia as also 4 / Hb Count is shown to be 2.4, I find it appropriate to direct respondent authorities to maintain status-quo as it exist today with respect to place of posting of petitioner till representation submitted by petitioner is decided. 7.
