The instant bail application has been filed under sections 483 and 484 of the BNSS, 2023, for grant of regular bail, in connection with Garhwa P.S. Case No. 648 of 2025, for the offence punishable under sections 21(c),22(c) of N.D.P.S. Act and section 27(b)(ii) & 27(d) of Drugs and Cosmetics Act, pending in the court of learned District and Additional Sessions Judge-II, Garhwa. 2. This case relates to sale and purchase of 480 pieces Avil Pehniramine Maleate Injection I.P. 10 ml Vail and 400 pieces Rexogesic Buprenorphine Injection I.P. 0.3 mg/ml vial without any valid license. 3. The learned counsel appearing for the petitioner has submitted that neither the petitioner is the owner of the seized articles nor he was selling the same in the market. The petitioner has no criminal antecedent and he is in custody since 18.12.2025.Therefore, he may be released on bail. 4. The learned counsel appearing on behalf of the State has vehemently opposed the prayer for bail and submitted that the narcotics substance seized from the possession of the petitioner are 480 pieces Avil Pehniramine Maleate Injection I.P. 10 ml Vail and 400 pieces Rexogesic Buprenorphine Injection I.P. 0.3 mg/ml Vial which is commercial in quantity. 5. Heard the learned counsel for the parties, gone through the impugned order, the affidavits and the first information report. 6. Considering the facts that the petitioner is named in the FIR and there is direct allegation against him for committing the alleged offence and he has been arrested with 480 pieces Avil Pehniramine Maleate Injection I.P. 10 ml Vail and 400 pieces Rexogesic Buprenorphine Injection I.P. 0.3 mg/ml Vial of narcotic drugs and psychotropic substance which is commercial quantity, this Court is of the view that the present application is fit to be dismissed. 7.
