1. This bail application has been filed on behalf of the accused- petitioners under Section 483 of B.N.S.S. in connection with FIR No.54/2025 registered at Police Station Nihalganj, District Dholpur for the offence(s) under Section 303(2) of BNS, 2023.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case and the accused persons are behind the bars since long. He further

Co-accused- Patanga @ Kulhad has already been enlarged on bail by Coordinate Bench of this Court on 17.10.2025 in S.B. Criminal Miscellaneous Bail Application No.13125/2025. There are no criminal antecedents against the petitioner-Irfan and six criminal antecedents have been reported against the accused-petitioners- Rizwan, Imran and Bhetu @ Bhedhu but in all the cases they have been bailed out. He further submits that the conclusion of trial may take long time, so no fruitful purpose would be served by keeping the petitioners in custody and therefore, prays that the petitioners may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioners hereinabove and submits that there are criminal antecedents against accused-petitioners-Rizwan, Imran and Bhetu @ Bhedhu. 4. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioners that the co-accused has already been enlarged on bail by Coordinate Bench of this Court and trial will take its own time. Without expressing any opinion on the merits/demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail. 5. Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioners-Rizwan S/o Mosin, Imran S/o Rahees, Bhetu @ Bhedhu S/o Santra @ Raheem and Irfan S/o Firoj are ordered to be released on bail, provided they furnish a personal bond in the sum of Rs.50,000/-
[2026:RJ-JP:11524] (3 of 3) [CRLMB-3055/2026] with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that they shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so. 6. It is made clear that the accused-petitioners-Rizwan, Imran and Bhetu @ Bhedhu shall not be involved in any other offence(s) during currency of the bail and they shall mark their presence on 1st and 15th day of every month in the concerned police station. 7.
In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application against the accused-petitioners for cancellation of the bail before the concerned Court. 8.
