No.909 of 2026 2. The learned counsel for the petitioner would submit that, owing to a lack of communication, the petitioners were unable to keep track of the proceedings, which resulted in a delay of 1058 days in filing the present appeal. 3. The learned counsel appearing for the third respondent raised a strong objection, contending that the petitioner is wantonly dragging on the proceedings with the sole intention of protracting the litigation. 4. Considering the fact that to give one more opportunity to the petitioner, this Petition is allowed and the delay of 1058 days is condoned on payment of cost of Rs.5,000/- (Rupees Five Thousand only) to the learned counsel for the third respondent within two weeks from today. On production of receipt of such payment, the Registry is directed to number the second appeal, if the papers are otherwise in order and list the same for admission on 12.08.2026. 13.07.2026 LS 2/3 https://www.mhc.tn.gov.in/judis CMP(MD).
