Present C-528 application has been filed by the applicant seeking a direction to the learned 3rd Additional Judicial Magistrate, Dehradun to expedite the proceedings of Case No. 3141 of 2024, ‘State vs. Amit Singh & Others’, relating to offences punishable under Sections 406, 420, 504 and 506 I.P.C., within a time frame to be fixed by this Court. 4. Learned counsel for the applicant would submit that the applicant is the complainant in F.I.R. No. 143 of 2023. It is alleged that the applicant had entered into an agreement with respondent no. 2, and pursuant to the said agreement, the father of the applicant paid a certain amount to respondent no. 2. However, despite receiving the money, the respondents failed to execute the sale deed in favour of the applicant; that, after completion of investigation, the Investigating Officer submitted a chargesheet against respondent nos. 2 to 4. On which, learned trial court took cognizance and issued summoning order dated 23.04.2024. Thereafter, charges were framed 2026:UHC:1271 against respondent nos. 2 to 4 on 20.08.2025. It is further submitted that after framing of charges, only the examination-in-chief of PW-1 has been conducted, and his cross-examination is still pending. 5. Learned counsel further submits that even after lapse of about six months from the date of framing of charges, the trial is proceeding at a slow pace. The applicant is facing financial hardship as the money paid by him has not been returned, and therefore, delay in trial is causing serious prejudice to him. Hence, a direction for expeditious disposal of the case is prayed for. 6. In view of the above facts and circumstances, the C-528 application is disposed of with a direction to the court concerned to make all endeavour to decide Case No. 3141 of 2024, State vs. Amit Singh & Others, pending before the learned 3rd Additional Judicial Magistrate, Dehradun, as expeditiously as possible, preferably within a period of one year from the date of production of certified copy of this order, without granting unnecessary adjournments to either party. 7.
