For Petitioner : Mr.N.Sathishwaran For Respondents : Mrs.K.Porkodi Counsel for the Government of Tamil Nadu O R D E R This contempt petition has been filed by the petitioner complaining willful disobedience of the order dated 19.07.2024, in W.P.(MD) No.16151 of 2024, passed by this Court, whereby the respondents were directed to disburse the petitioner's retirement and other applicable benefits within a period of four weeks from the date of receipt of a copy of that order. 2. As the respondents have not complied with the orders passed by this Court, this Court issued statutory notice to the third respondent on 17.04.2026 and accordingly, the third respondent / contemnor appeared before this Court on 05.06.2026 and submitted that the petitioner was paid a ____________ https://www.mhc.tn.gov.in/judis Cont.P.(MD) No.1039 of 2026 sum of Rs.1,00,000/- and the balance amount would be paid in installments in view of the weak financial condition of the respondent – Society. 3. Taking the same into consideration, this Court directed the third respondent to file an affidavit to that effect. Accordingly, the present Administrator of the respondent – Society, by name, M.Valarmathi, who is now substituted as the third respondent in this contempt petition, filed an affidavit before this Court on 01.07.2026 undertaking to pay the balance amount in 24 monthly installments. 4. In view of the said affidavit filed by the third respondent, on 03.07.2026 when the matter came up for consideration, learned counsel for the petitioner took time to get instructions to verify the financial condition of the respondent – Society. 5. Today, when the matter is taken up for further consideration, learned counsel for the petitioner submitted that the financial condition of the respondent – Society is not so weak to disburse the retirement benefits due and payable to the petitioner in 24 monthly installments. ____________ https://www.mhc.tn.gov.in/judis Cont.P.(MD) No.1039 of 2026 6. Admittedly, as on date, a sum of Rs.9,50,655/- is due and payable to the petitioner and the same was in fact due as on the date of superannuation of the petitioner i.e., on 31.03.2024 and more than two years lapsed since the date of superannuation of the petitioner and still he is not paid the retirement benefits. Considering the same, this Court is not inclined to grant 24 monthly installments to comply with the orders passed by this Court for releasing the balance amount. As the third respondent is seeking further time for releasing the terminal benefits due and payable to the petitioner, which was due as early as on 31.03.2024, the third respondent has to compensate the petitioner appropriately for the belated payment. 7. Accordingly, the third respondent is permitted to pay the balance amount of Rs.9,50,655/- in 12 equal monthly installments, together with interest at the rate of 6% per annum from the date of the petitioner's retirement till the date on which the said amount is paid to the petitioner.
