And In the matter of : Sariful Islam @ Kalu Sk. ……Petitioner. Mr. Kaustav Das
.....for the Petitioner. Mr. Ranojoy Chatterjee Mr. Deepak Khetawat
……for the State. Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of the statement of the co-accused. Other accused persons have been acquitted of the charge, petitioner has subsequently surrendered and is in custody for three months ten days. State has opposes the prayer for bail but is unable to refute that except statement of co-accused there are no other materials, particularly, the CDR or money trail. However, State submits that there are number of antecedents against the petitioner. But so far as the antecedents are concerned according to the State in none of the cases there has been any recovery, he has been implicated on the basis of statement of co-accused. In view of the submissions, I am of the opinion that petitioner be released on bail. As such, prayer for bail of the petitioner is allowed. 2 As such, the petitioner, namely, Sariful Islam @ Kalu Sk. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 4th Court, Malda.
