ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 2 to 3 to measure (Survey), demarcate and fix the boundaries with the protection of the 4th respondent.
2. The learned counsel for the petitioners submits that the land measuring an extent of 19 cents comprised in Survey No. 479/1, situated at Korakavadi Village, Thittakudi Taluk, Cuddalore District (formerly Virudhachalam), originally belonged to one Arumugam by virtue of a Sale Deed registered as Document No. 1015 of 1987 in the office of the Sub-Registrar, Sirupakkam. The said Arumugam subsequently executed Settlement Deeds, settling an extent of 9.5 cents in favour of his first son (the 1st petitioner herein) and the remaining 9.5 cents in favour of his second son (the 2nd petitioner herein).
3. While the petitioners have been in peaceful possession and enjoyment of their respective properties, the 5th respondent has been causing continuous obstruction and interference. Aggrieved by the same, the wife of the 1st petitioner, acting for and on behalf of the petitioners, submitted a formal representation dated 18.11.2025 to the 1st and 4th respondents. The said representation was duly forwarded by the Revenue Divisional Officer, __________ Page3 of 6 https://www.mhc.tn.gov.in/judis
WP No. 26022 of 2026 Virudhachalam, to the 2nd respondent for appropriate action. However, despite the lapse of considerable time, the 2nd respondent has failed to consider or pass orders on the said representation. Left with no other alternative remedy, the petitioners have filed the present Writ Petition seeking a mandamus to dispose of the same.
4. Heard the learned counsel appearing for the petitioner and learned Government Counsel appearing for the respondents.
5. Considering the facts and circumstances of the case and the
submissions made on either side, this Court directs the respondents 2 and 3 to consider the petitioners’ online application dated 19.02.2025 and conduct survey of the subject property in S.No.479/1, situated at Korakavadi Village, Thittakudi Taluk, Virudachalam, and fix boundary stones within a period of six (6) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the 4th respondent Police, and the 4th respondent Police are mandated to provide necessary police protection.
