The present petition has been filed by the petitioners under Article 226 of the Constitution of India, with the following prayers :- “10.1 That, the Hon'ble Court may kindly call for records pertaining to case of the petitioner. 10.2. That the Hon'ble Court may kindly be pleased to set aside and quash the impugned order dated 10/12/2025 issued by the respondent authorities, in the interest of justice. 10.3. That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner firm to participate in future tender's. 10.4. That, any other relief, which this Hon'ble Court may deemed just and fit in facts and circumstances of the case.” 3. Learned counsel for the petitioner submits that he wants to withdraw the instant petitioner with liberty to file fresh petition as the document which has been annexed with the present petition is of the different tender. 4. It transpires that the petition has been filed by the petitioner is in a very casual manner leading to wastage of the Court's precious time as the document which has been annexed with the present petition is of the different tender. 5. Accordingly, the instant petition is dismissed as withdrawn with liberty to file afresh petition subject to depositing a sum of Rs.2,000/- as cost by the petitioner before the Registry of this Court and submit a receipt of the same at the time of filing of the 3 fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Government Home for Mentally Underdeveloped Children Mana Camp, District - Raipur (C.G.).
