BEFORE HONOURABLE MR. JUSTICE NELSON SAILO HONOURABLE MR. JUSTICE PRANJAL DAS ORDER Date : 09.02.2026 (Nelson Sailo, J)
Heard Mr. S. Saikia, learned counsel for the applicant, who submits that by filing this application, the applicant seeks for condonation of 3(three) days in filing the connected appeal against the judgment and order dated 13.08.2025 passed by the Court of Additional Sessions Judge-cum-Special Judge (POCSO) Sivasagar in Special (POCSO) Case No.20/2024. The learned counsel referring to the application submits that since the applicant requires some time to make preparation to come to Guwahati from his native place to arrange a counsel, the applicant could not file the appeal within the period of limitation. He submits that in view of the bonafide reasons for the delay, the delay may be condoned. Mr. R. R. Kaushik, learned Addl. P.P submits that he has no objections and that the appeal may be considered on merit. Upon hearing the learned counsel for the parties and upon perusal of the application, we condone the delay of 3(three) days in filing the connected appeal.
