The petitioner has filed this petition seeking the following relief(s):- “10.i. That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to consider the candidature of the petitioner and issue the appointment order in his favour on the post of Assistant Director (Public Relation). Any other relief, which this Hon'ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice.” 2. Mr. Gupta, learned counsel for the petitioner would submit that an advertisement dated 26.08.2020 was issued for filling up 05 posts of Assistant Director (Public Relation) English Medium. He would further submit that the pursuant to the said advertisement, the petitioner participated in the selection process and after verification of the documents petitioner was allowed to appear in the interview, thereafter, vide letter dated 10.02.2021, the four selected candidates were called for verification of document on 15.02.2021 and appointment order(s) were issued in favour of two candidates namely Sujit Kumar Singh & Pradeep Singh Kanwar and appointment order was not issued in favour of the petitioner, thereafter representation was made before the authorities concerned on 22.06.2021. He would contend that till date, no decision has been taken with regard to candidature of the petitioner on the ground that the petitioner did not possess the requisite qualification of graduation degree with English as one of the subjects. Mr. Gupta would further contend that English language was a subject in the B. Tech first semester. English was one of the subjects, therefore, the respondent authorities ought to have considered the candidature of the petitioner. He prayed that an appropriate direction may be issued to the respondent authorities to consider the name of petitioner. 3. On the other hand, Mr. Anil S. Pandey, learned Government Advocate appearing for the State would submit that documents of the petitioner were not verified properly at the time of interview process, but as per 3 the advertisement dated 26.08.2020, it is specifically mentioned in Para 7 (2) (IV) necessary academic qualifications (Ka), that candidate must possess graduation degree with English as one of the subjects whereas petitioner was lacking such qualification. He would contend that instead of English subject, Communication Skill was a subject in the first semester of his B. Tech; thus, decision taken by the respondent authorities is just and proper and the present writ petition deserves to be dismissed. 4. Heard learned counsel for the parties and perused the documents. 5. The required qualification for the post of Assistant Director, Public Relations (English Medium) was a Bachelor's degree with English as one of the subjects from a recognized University, along with a degree in Journalism in English medium from a recognized University. 6. From perusal of the B.Tech mark-sheet, of the petitioner, it is evident that “Communication Skills” was a subject in the first semester; however, English was not a subject in the subsequent semesters, thus required qualification was lacking as per advertisement dated 26.08.2020. 7. Taking into consideration the qualification prescribed in the advertisement for the post of Assistant Director (Public Relations), no case is made out for grant of any relief, accordingly, this petition is hereby dismissed.
