CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR
CAV ORDER
All these petitions arise out of common order dated 21.10.2021 passed in O.S.No.25863/2020 by the LVII Addl.City Civil and Sessions Judge, Mayo Hall Unit, Bangalore, whereby identical / similar applications filed by the petitioners who are defendants 1, 2, 3, 10, 15, 16, 21, 22, 24, 26, 28 and 29 under
Order 7 Rule 11 CPC seeking rejection of the plaint was dismissed by the trial court.
2. Since common questions of law and fact arise for
consideration in the suit, out of which, the present petitions arise, coupled with the fact that the trial court has passed the impugned common order which is assailed in all the petitions, they are taken up together and disposed of by this common order. 3. Briefly stated the facts giving rise to the present petitions are as under:-
The 1st respondent in all the petitions is the plaintiff in the suit claiming to be the Karnataka Film Producers Association which instituted the aforesaid suit for permanent injunction restraining the

petitioners – defendants and other defendants from infringing, exhibiting, telecasting etc., the movies mentioned in the schedule to the plaint and for other reliefs. The said suit is being contested by the defendants who also filed the instant applications seeking rejection of the plaint under Order 7 Rule 11 (a) and (d) CPC. The plaintiff having filed objections to the said applications, the trial court proceeded to pass the impugned common order rejecting all the applications filed by the petitioners - defendants 1, 2, 3, 10, 15, 16, 21, 22, 24, 26, 28 and 29, who are before this Court by way of the present petitions. 4. Heard Sri.S.S.Naganand, learned Senior counsel for the petitioners and learned Sri.V.Lakshminarayana, learned Senior counsel for the 1st respondent as well as other learned counsel for remaining respondents and perused the material on record. 5. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned Senior counsel for the petitioners submitted that the trial court committed an error in failing to consider and appreciate that the plaintiff which was not the owner or licencee of the copyright was not entitled to

maintain the suit which was not maintainable in view of Sections 54 and 55 r/w Section 61(1) of the Copyright Act, 1957 (for short ‘the said Act of 1957’) and the plaint was liable to be rejected.
It was contended that the plaintiff did not have locus standi to institute the suit since civil remedies for infringement of copyright can be initiated only by the Producers who were the alleged owners of the alleged copyright and the plaintiff who did not have any personal interest over the subject matter of the suit were not entitled to institute or prosecute the suit for permanent injunction which was specifically barred under Section 41(j) of the Specific Relief Act,
1963. It was also submitted that apart from the fact that the plaintiff was not a registered copyright society as contemplated under Section 33 of the said Act of 1957, the plaintiff being a private association allegedly registered under the Karnataka Societies Registration Act was not entitled to sue for copyright infringement which can be instituted only by the Producers who were the alleged owners of the copyright as per the averments made in the plaint. 5.1 Learned Senior counsel would elaborate his arguments and submit that in addition to the fact that the Producers of the plaint schedule films had not been arrayed / impleaded as parties to

the suit, despite being both proper and necessary parties, the plaint does not reveal / disclose a cause of action and in contravention of Section 61 of the said Act of 1957. It was pointed out that the trial court erred in placing reliance on certain letters / complaints said to have been written by the Producers to the plaintiff without appreciating that the suit said to have been filed by the President of the plaintiff - Association was contrary to the Byelaws of the Association and the suit being bad for non-joinder and mis-joinder of parties and causes of action was liable to be dismissed. It was therefore submitted that the trial court had not considered all these aspects while passing the impugned order which is contrary to law and facts and the same was liable to be rejected. In support of his
submissions, learned Senior counsel places reliance upon the following judgments:-
(i) Achla Sabharwal v. National Film Development Corp. Ltd. And Anr - 2017 SCC OnLine Del 12009; (ii) Jorden Electronics and Anr.v. Bombino Video (P) Ltd., - 2007 (98) DRJ 218; (iii) The Periyar Self Respect Propaganda Institution v. Periyar Dravidar Kazhagam - (2010) 2 CTC 365;

Per contra, learned Senior counsel for the 1st respondent would support the impugned order and submit that for the purpose of considering an application for rejection of the plaint under Order 7 Rule 11 CPC, it was only the plaint averments and documents produced along with it that were relevant and germane and neither the written statement or documents filed by the defendants nor their application or affidavit under Order 7 Rule 11 CPC could be looked into for the purpose of considering rejection of plaint and as such, the trial court correctly rejected the applications filed by the defendants. It was submitted that apart from the fact that the plaint clearly disclose a cause of action, the plaintiff – Association which was duty bound to institute the suit on behalf of its members /

Producers who were owners of the copyrights in respect of the plaint schedule movies had filed the suit on their behalf which was permissible under the Byelaws / Memorandum of Articles of Association of the plaintiff in order to protect the interest of its members. It was therefore submitted that the impugned order passed by the trial court does not warrant interference by this Court the present petitions, which were liable to be dismissed.

As can be seen from the plaint averments, the plaintiff specifically contends that it is a registered Association having its own Byelaws, thereby indicating that undisputedly, the plaintiff – Association is an independent, juristic and legal entity which has instituted the suit in its own name through its President – Sri.D.K.Ramakrishna. It is also an undisputed fact that the various 121 Producers whose names are contained at paragraph – 7 of the plaint have not been impleaded as parties to the suit. Further, at paragraphs- 9 and 10 of the plaint, it is categorically stated that the aforesaid Producers are the owners of the copyright in respect of which, the plaintiff contends that there has been infringement by the defendants.
At paragraphs 11 to 16, the plaintiff has put forth various averments and contentions wherein it is repeatedly reiterated that the copyright to the schedule films / movies were owned by the said Producers (not made parties to the suit) and that in order to protect their rights, the suit was filed for permanent injunction since the defendants were continuing to infringe the copyrights of the said Producers. In the cause of action column at

paragraphs-17 of the plaint, plaintiff specifically states that the schedule movies were produced and owned by the Producers on whose behalf, the suit was being filed. Interestingly, in the entire plaint, plaintiff – Association does not claim to be the owner / licencee / exclusive licencee of the plaint schedule movies owned and possessed by the Producers (non – parties) whose copyrights are alleged to have been infringed by the defendants. 10. The aforesaid plaint averments and the documents produced along with the plaint are sufficient to come to the conclusion that even according to the plaintiff – Association, it was not the owner of the copyrights in relation to the plaint schedule movies which were owned and possessed exclusively by the Producers; so also, the plaintiff does not claimed to be a licencee or an exclusive licencee of the schedule copyrights; in this context, it is necessary to extract Sections 54 and 55 of the Copyright Act, 1957 which reads as under:-
“ 54.

the work, until the identity of the author or, in the case of an anonymous work of joint authorship, or a work of joint authorship published under names all of which are pseudonyms, the identity of any of the authors, is disclosed publicly by the author and the publisher or is otherwise established to the satisfaction of the 1[Appellate Board] by that author or his legal representatives. 55. Civil remedies for infringement of copyright.— (1) Where copyright in any work has been infringed, the owner of the copyright shall, except as otherwise provided by this Act, be entitled to all such remedies by way of injunction, damages, accounts and otherwise as are or may be conferred by law for the infringement of a right: Provided that if the defendant proves that at the date of the infringement he was not aware and had no reasonable ground for believing that copyright subsisted in the work, the plaintiff shall not be entitled to any remedy other than an injunction in respect of the infringement and a decree for the whole or part of the profits made by the defendant by the sale of the infringing copies as the court may in the circumstances deem reasonable.

respect of infringement of copyright in such work, be presumed, unless the contrary is proved, to be the author or the publisher of the work, as the case may be. (3) The costs of all parties in any proceedings in respect of the infringement of copyright shall be in the discretion of the court.”
11. A plain reading of the aforesaid provisions is sufficient to come to the conclusion that it is only the owner of a copyright who can maintain a suit for copyright infringement and a person who is neither the owner nor a licencee nor an exclusive licencee of a copyright does not have locus standi nor would be entitled to institute or maintain a suit for copyright infringement; in the instant cases, it is an undisputed fact as borne out from the material on record that the plaintiff is a registered Association which is an independent, legal and juristic entity which is separate and mutually exclusive from the Producers / members for the purpose of ownership of copyrights as contemplated under Sections 54 and 55 of the said Act of 1957.
In other words, so long as the instant suit was not filed by the Producers who were the owners of the plaint schedule copyrights nor were they made party-defendants to the suit, the instant suit by the plaintiff who was not the owner of the

plaint schedule copyrights was not entitled to institute or maintain the suit, which was clearly barred under Sections 54 and 55 of the said Act of 1957, thereby leading to the sole and unmistakable conclusion that the suit was not maintainable and the plaint was liable to be rejected. 12. In Achala Sabarwal’s case supra, the Delhi High Court held as under:-
“ 11. In my opinion, the trial court has also rightly dismissed the suit by placing reliance upon Section 61 of the Copyright Act, 1957 and the spirit of which provision is that once there are disputes with respect to who was the actual owner of the copyright, then in such a case an owner of the copyright in the film as on 15.7.2007 ought to have been made party to the suit. In the present case, the last owner in the chain from whom the appellant/plaintiff purchased terrestrial rights in the film was M/s Spotlight, and therefore M/s Spotlight or actually M/s Mima Real Estate Advisors Pvt. Ltd. ought to have been made a party but since such entity was not made as a party defendant, the trial court was hence justified in holding the suit to be bad on account of non-joinder of necessary party in accordance with the spirit of Section 61 of the Copyright Act. The relevant observations of the trial court in this regard are contained in paras 11.7 to 11.10 of the impugned judgment and these paras read as under:—

Evident to note that the film was telecasted on 15.07.2007 on the offer made by M/s Mima Real Estate Advisors Pvt. Ltd; the film was offered vide letter dated 31.05.2007 by the said firm; all the link and necessary documents are stated to have been provided by M/s Mima Real Estate Advisors Pvt. Ltd. to defendants; the royalty amount against the screening of the film was withheld after coming to know of the claim of the assignment rights by the plaintiff. These facts were well within the knowledge of the plaintiff at the time of filing of the present suit, therefore, when there was per-se dispute to the assignment of terrestrial rights between the plaintiff and the M/s Mima Real Estate Advisors Pvt. Ltd. in my considered view, M/s Mima Real Estate Advisors Pvt. Ltd. ought to have been arrayed as a defendant as a necessary party for complete and effective adjudication of the dispute herein. The outcome of the suit would have direct bearing of the legal rights of the M/s Mima Real Estate Advisors Pvt. Ltd on whose offer the film was telecasted on Doordarshan by D-1. 11.8. Herein when the application for impleadment of M/s Mima Real Estate Pvt. Ltd. was moved on behalf of defendant no. 1 plaintiff had vehemently opposed the said application. I fail to understand why the plaintiff was shying away to add the M/s Mima Real Estate Pvt. Ltd. in the array of parties when admittedly there was a dispute between them regarding the assignment of terrestrial rights, more the so, when the film was telecasted on an offer not made by the plaintiff but by the M/s Mima Real Estate Pvt. 11.9.
Further, a reference to Section 61 of the Copy Right Act would also be relevant which states that “In every civil suit or other proceedings regarding infringement of copyright instituted by an exclusive licensee, the owner of the copyright shall, unless the court otherwise directs, be made a defendant and where such owner is made a defendant, he shall have the right to dispute the claim of the exclusive licensee”. Plaintiff has neither impleaded the owners of the copy rights nor the assignees in the present case. Nor the leave of the court was taken in this regard. 11.10. Therefore, in light of my above discussion, I am of the view that the suit is bad for non-joinder of necessary parties especially M/s Mima Real Estate Advisors Pvt. Ltd. and accordingly the issue is decided in favour of the defendant and against the plaintiff.”
12. Learned counsel for the appellant/plaintiff argues that since the application to add M/s Mima Real Estate Advisors Pvt. Ltd. was dismissed by the trial court in terms of its order dated 26.4.2012, and therefore, now it could not be held that the suit is bad for nonjoinder of M/s Spotlight or M/s Mima Real Estate Advisors Pvt. Ltd. (now known as Mima Cinevision Pvt. Ltd.), however this argument is misconceived because even if an application under Order I Rule 10 CPC is dismissed, which was moved by the respondents/defendants, the same did not exempt the appellant/plaintiff from the requirement of complying with the spirit of Section 61 of the Copyright Act because after all the appellant/plaintiff has to prove her entitlement, to the royalty

charges/telecast rights and such entitlement can only arise in case of a clear cut title of the subject film in favour of the appellant/plaintiff. Trial court rightly discusses this aspect for holding the same against the appellant/plaintiff as per para 11.8 of the impugned judgment and which para 11.8 is reproduced above. Appellant/plaintiff however has failed to do the needful and the trial court was therefore justified in dismissing the suit including on the ground of non-joinder of necessary parties.”

The claim of the plaintiff is vehemently disputed by the defendant who has taken a strong objection even to the maintainability of the lis, as the suit has been filed without joining the producers of the films. The defendant has also set up a claim of having exclusive copyright in five of the films relying on agreements in its favour. 6. I find that the defendant is claiming subsisting and exclusive video rights in respect of only five films which are titled Arth, Jeete Hain Shaan Se, Sharara, Kalakaar and Ek Haseena Thi. The defendant is not claiming any rights in respect of the remaining eighteen films. It has also been stated that the defendant has not conducted any business in respect of these eighteen films. which the defendant is claiming rights, Mr. Ravi Aggarwal,
learned counsel for the defendant has urged that the plaintiff has no rights therein and for this reason the application merits dismissal.”
12. Be that as it may, the plaintiff has not been able to support that the agreement dated 16th September, 2004 was executed and the rights assigned in its favour by any authorised person on behalf of the producer. It is well settled that in
order to be entitled to an injunction, the plaintiff has to establish a prima facie legal right to the same. In the absence of primafacie establishing that the agreement dated 16th September, 2004 in its favour had been executed by any person on behalf of the producer, the plaintiff would not be entitled to any injunction against the defendant even if the agreement infavour of the defendant stood cancelled.
27. The defendant has repeatedly pointed out the failure of the plaintiff to comply with the mandate of Section 61 of the Copyright Act, 1957 which requires that in every civil suit or other proceedings regarding infringement of copyright instituted by an exclusive licensee, the owner of the copyright would have the right to dispute the claim of the exclusive licensee. The plaintiff has failed to take any steps for impleading the producers and the owners of the copyright as parties to the present suit and would therefore be not entitled to injunction for this reason as well.

Corporation & Ors. in support of its several
contentions. This judgment also reiterates the principles which would guide the court while considering grant of injunction in respect of a contract entered into between parties whereby copyright was assigned in favour of one or the other party. 29. In the light of the foregoing discussion, in my view, the plaintiff has failed to make out a prima facie case for grant of interim protection so far as films Arth, Jeete Hai Shaan Se, Sharara, Kalakaar and Ek Hasina Thi are concerned, consequently requires to be rejected. The same therefore is hereby dismissed. So far as the remaining films are concerned, the defendant is not claiming any rights therein and therefore the apprehension of the plaintiff in respect thereof is misconceived. Association represented by its Secretary Mr. K. Veeramani and whether they are entitled to get a temporary injunction against the respondents are the issues involved in this Application. 37. In the present case, a reading of memorandum of association and the Rules and Regulations does not disclose any such vesting of ownership with the society. In fact, Rules 22 and 23 only talk about future purchases of properties vesting with the society. The copyright in literary materials can only be an intellectual property and there has to be material to show that it was specially assigned. It is an admitted case that Periyar (E.Ve.Ra.) died intestate and there is no written or other materials to show that a copyright has been reserved by him as an author of those articles and that he also assigned it in favour of the plaintiff. 41.
If it is seen in the above factual matrix and legal precedents, then it can be safely held that the plaintiff had failed to establish any ownership of the copyright in their favour and a corresponding infringement of copyright on the part of the respondents. Neither there is a prima facie case nor balance of convenience is in favour of grant of any interim
order or to continue the
order of injunction. The applicant/plaintiff has not made out any case. The issue raised here is squarely covered by the exemption provided under Section 52(1)(m) of the Copyright Act, 1957. Accordingly, the Application is dismissed. No costs.”

“11. Rejection of plaint.—The plaint shall be rejected in the following cases— (a) where it does not disclose a cause of action; (b) where the relief claimed is undervalued, and the plaintiff, on being required by the court to correct the valuation within a time to be fixed by the court, fails to do so; (c) where the relief claimed is properly valued but the plaint is written upon paper insufficiently stamped, and the plaintiff, on being required by the court to supply the requisite stamp paper within a time to be fixed by the court, fails to do so; (d) where the suit appears from the statement in the plaint to be barred by any law; (e) where it is not filed in duplicate; (f) where the plaintiff fails to comply with the provisions of Rule 9: Provided that the time fixed by the court for the correction of the valuation or supplying of the requisite stamp-papers shall not be extended unless the court, for reasons to be recorded, is satisfied that the plaintiff was prevented by any cause of an exceptional nature from correcting the valuation or supplying the requisite stamp- papers, as the case may be, within the time fixed by the court and that refusal to extend such time would cause grave injustice to the plaintiff.”

empowered to summarily dismiss a suit at the threshold, without proceeding to record evidence, and conducting a trial, on the basis of the evidence adduced, if it is satisfied that the action should be terminated on any of the grounds contained in this provision. 23.3. The underlying object of Order 7 Rule 11(a) is that if in a suit, no cause of action is disclosed, or the suit is barred by limitation under Rule 11(d), the court would not permit the plaintiff to unnecessarily protract the proceedings in the suit. In such a case, it would be necessary to put an end to the sham litigation, so that further judicial time is not wasted. 23.4. In Azhar Hussain v. Rajiv Gandhi [Azhar Hussain v. Vijaykunverba, 1998 SCC OnLine Guj 281 : (1998) 2 GLH 823] this Court held that the whole purpose of conferment of powers under this provision is to ensure that a litigation which is meaningless, and bound to prove abortive, should not be permitted to waste judicial time of the court, in the following words : (SCC p. 324, para 12)
“12. … The whole purpose of conferment of such powers is to ensure that a litigation which is meaningless, and bound to prove abortive should not be permitted to occupy the time of the court, and exercise the mind of the respondent. Even in an ordinary civil litigation, the court readily exercises the power to reject a plaint, if it does not disclose any cause of action.”

23.5. The power conferred on the court to terminate a civil action is, however, a drastic one, and the conditions enumerated in Order 7 Rule 11 are required to be strictly adhered to. 23.6.
Under Order 7 Rule 11, a duty is cast on the court to determine whether the plaint discloses a cause of action by scrutinising the averments in the plaint [Liverpool & London S.P. & I Assn. Ltd. v. M.V. Sea Success I, (2004) 9 SCC 512] , read in conjunction with the documents relied upon, or whether the suit is barred by any law. 23.7. Order 7 Rule 14(1) provides for production of documents, on which the plaintiff places reliance in his suit, which reads as under:
“14. Production of document on which plaintiff sues or relies.—(1) Where a plaintiff sues upon a document or relies upon document in his possession or power in support of his claim, he shall enter such documents in a list, and shall produce it in court when the plaint is presented by him and shall, at the same time deliver the document and a copy thereof, to be filed with the plaint. (2) Where any such document is not in the possession or power of the plaintiff, he shall, wherever possible, state in whose possession or power it is. (3) A document which ought to be produced in court by the plaintiff when the plaint is presented, or to be entered in the list to be added or annexed to the plaint but is not produced or entered accordingly, shall not, without the leave of the court, be received in evidence on his behalf at the hearing of the suit. (4) Nothing in this Rule shall apply to document produced for the cross-examination of the plaintiff's witnesses, or, handed over to a witness merely to refresh his memory.”

23.8. Having regard to Order 7 Rule 14 CPC, the documents filed along with the plaint, are required to be taken into consideration for deciding the application under Order 7 Rule 11(a). When a document referred to in the plaint, forms the basis of the plaint, it should be treated as a part of the plaint. 23.9.
In exercise of power under this provision, the court would determine if the assertions made in the plaint are contrary to statutory law, or judicial dicta, for deciding whether a case for rejecting the plaint at the threshold is made out. 23.10. At this stage, the pleas taken by the defendant in the written statement and application for rejection of the plaint on the merits, would be irrelevant, and cannot be adverted to, or taken into consideration. [Sopan Sukhdeo Sable v. Charity Commr., (2004) 3 SCC 137]
23.11. The test for exercising the power under Order 7 Rule 11 is that if the averments made in the plaint are taken in entirety, in conjunction with the documents relied upon, would the same result in a decree being passed. This test was laid down in Liverpool & London S.P. & I Assn. Ltd. v. M.V. Sea Success I [Liverpool & London S.P. & I Assn. Ltd. v. M.V. Sea Success I, (2004) 9 SCC 512] which reads as : (SCC p. 562, para 139)
“139. Whether a plaint discloses a cause of action or not is essentially a question of fact. But whether it does or does not must be found out from reading the plaint itself. averments made in the plaint are taken to be correct in their entirety, a decree would be passed.”
23.12. In Hardesh Ores (P) Ltd. v. Hede & Co. [Hardesh Ores (P) Ltd. v. Hede & Co., (2007) 5 SCC 614] the Court further held that it is not permissible to cull out a sentence or a passage, and to read it in isolation. It is the substance, and not merely the form, which has to be looked into.
The plaint has to be construed as it stands, without addition or subtraction of words. If the allegations in the plaint prima facie show a cause of action, the court cannot embark upon an enquiry whether the allegations are true in fact. D. Ramachandran v. R.V. Janakiraman [D. Ramachandran v. R.V. Janakiraman, (1999) 3 SCC 267; See also Vijay Pratap Singh v. Dukh Haran Nath Singh, AIR 1962 SC 941] . 23.13. If on a meaningful reading of the plaint, it is found that the suit is manifestly vexatious and without any merit, and does not disclose a right to sue, the court would be justified in exercising the power under Order 7 Rule 11 CPC. 23.14. The power under Order 7 Rule 11 CPC may be exercised by the court at any stage of the suit, either before registering the plaint, or after issuing summons to the defendant, or before conclusion of the trial, as held by this Court in the judgment of Saleem Bhai v. State of Maharashtra [Saleem Bhai v. State of Maharashtra, (2003) 1 SCC 557] . The plea that once issues are framed, the matter must necessarily go to trial was repelled by this Court in Azhar Hussain case [Azhar Hussain v. Rajiv Gandhi, 1986 Supp SCC 315. Followed in Manvendrasinhji Ranjitsinhji Jadeja v.

Vijaykunverba, 1998 SCC OnLine Guj 281 : (1998) 2 GLH 823] . 23.15. The provision of Order 7 Rule 11 is mandatory in nature. It states that the plaint “shall” be rejected if any of the grounds specified in clauses (a) to (e) are made out. If the court finds that the plaint does not disclose a cause of action, or that the suit is barred by any law, the court has no option, but to reject the plaint. 24.
“Cause of action” means every fact which would be necessary for the plaintiff to prove, if traversed, in order to support his right to judgment. It consists of a bundle of material facts, which are necessary for the plaintiff to prove in
order to entitle him to the reliefs claimed in the suit.
24.1. In Swamy Atmananda v. Sri Ramakrishna Tapovanam [Swamy Atmananda v. Sri Ramakrishna Tapovanam, (2005) 10 SCC 51] this Court held : (SCC p. 60, para 24)
“24. A cause of action, thus, means every fact, which, if traversed, it would be necessary for the plaintiff to prove in order to support his right to a
judgment of the court. In other words, it is a bundle of facts, which taken with the law applicable to them gives the plaintiff a right to relief against the defendant. It must include some act done by the defendant since in the absence of such an act, no cause of action can possibly accrue. It is not limited to the actual infringement of the right sued on but includes all the material facts on which it is founded.”
24.2. In T. Arivandandam v. T.V. Satyapal [T. Arivandandam v. T.V. Satyapal, (1977) 4 SCC 467] this Court held that while considering an application under Order 7 Rule

“5. … The learned Munsif must remember that if on a meaningful—not formal—reading of the plaint it is manifestly vexatious, and meritless, in the sense of not disclosing a clear right to sue, he should exercise his power under Order 7 Rule 11 CPC taking care to see that the ground mentioned therein is fulfilled. And, if clever drafting has created the illusion of a cause of action, nip it in the bud at the first hearing.…”
24.3. Subsequently, in ITC Ltd. v. Debts Recovery Appellate Tribunal [ITC Ltd. v. Debts Recovery Appellate Tribunal, (1998) 2 SCC 70] this Court held that law cannot permit clever drafting which creates illusions of a cause of action. What is required is that a clear right must be made out in the plaint. 24.4. If, however, by clever drafting of the plaint, it has created the illusion of a cause of action, this Court in Madanuri Sri Rama Chandra Murthy v. Syed Jalal [Madanuri Sri Rama Chandra Murthy v. Owner of copyright to be party to the proceeding.— (1) In every civil suit or other proceeding regarding infringement of copyright instituted by an exclusive licensee, the owner of the copyright shall, unless the court otherwise directs, be made a defendant and where such owner is made a defendant, he shall have the right to dispute the claim of the exclusive licensee. (2) Where any civil suit or other proceeding regarding infringement of copyright instituted by an exclusive licensee is successful, no fresh suit or other proceeding in respect of the same cause of action shall lie at the instance of the owner of the copyright.”

18.
Section 61 supra, indicates that in a suit regarding infringement of copyright by an exclusive licencee , the owner of the copyright is both a proper and necessary party to the suit and any such suit without impleading the owners of the copyright was not maintainable; in the instant case, apart from the fact that the plaintiff-Association does not claim to be the licencee / exclusive licencee of the plaint schedule copyrights of which the Producers / Members were the owners, the said persons / entities had not been impleaded / arrayed as parties to the suit which was clearly bad for non-joinder of proper and necessary parties and consequently, the suit was not maintainable and the plaint was liable to be rejected on this ground also. 19.
19. The plaintiff has contended that it was an Association which had instituted the suit on behalf of its members / Producers to protect their interest in the plaint schedule copyrights and the suit was maintainable in law; the said contention cannot be accepted for more than one reason; there was no resolution or authorization by the Executive committee of the plaintiff – Association which permitted, empowered or authorised the President – Sri.D.K.Ramakrishna to present and prosecute the suit on behalf of

the plaintiff – Association; even according to the Byelaws, any action taken by the President on behalf of its members is to be ratified by the Executive committee and no such ratification for instituting the present suit is placed by the plaintiff in this regard and no other material is also available to establish that the President was entitled to present and prosecute the suit on behalf of the plaintiff-Association; further, the Byelaws which provide for constitution of an Executive committee also stipulates that it is only the Executive committee that can initiate legal action on behalf of the Association and not the President. 20. In the cases on hand, it is an undisputed fact that the plaint is filed by the President – D.K.Ramakrishna without any authorization or ratification by the Executive committee nor is there any resolution in his favour and consequently, it cannot be said that the present suit filed by D.K.Ramakrishna was maintainable in law, especially when the plaintiff – Association was not the owner of the plaint schedule copyrights and the suit was liable to be dismissed on this score also. 21. As stated supra, the plaintiff – Association is an independent legal and juristic entity which is not the owner of the

plaint schedule copyrights, thereby establishing that the plaintiff – Association does not have any personal interest in the subject matter of the suit.
In this context, it is apposite to refer to Section 41(j) of the Specific Relief Act, 1963, which reads as under:-
41(j) Relief of injunction- Held, The reliefs under the Specific Relief Act, 1963 are granted for the purpose of enforcing individual civil rights as will be clear from Section 4 of the Specific Relief Act. 1963. Accordingly, injunction under Part III of the Specific Relief Act, 1963 is granted to the plaintiff either to prevent a breach of an obligation in favour of the plaintiff, or to compel the performance of an obligation in favour of the plaintiff which needs to be enforced, the Court cannot grant injunction. Hence, it is provided in Section 41(j) of the Specific Relief Act 1963 that an injunction cannot be granted when the plaintiff has no personal interest in the matter. The Provisions of the Specific Relief Act, 1963 do not apply to the right conferred on the Corporation and any other person under sub-section (5) of Section 307 of M.P.Municipal Corporation Act, 1956. Under the Provisions of the Act of 1956 and every building must comply with the provisions of the Act of 1956 and the byelaws made thereunder and hence if there is any breach of the provisions of the Act of the 1956 or the bye-laws made thereunder, sub-section (5) of Section 307 of the Act of 1956 confers a right not only on the Corporation but also any other person to apply to the District Court for an injunction for removal or alteration of a building on the

ground that there has been the contravention of the provisions of the Act of 1956 or the bye-laws made thereunder.
This remedy under sub-section (5) of Section 307 of the Act of 1956 is independent of and different from the remedies under the Specific Relief Act 1963.”
22. As can be seen from the aforesaid provision, a suit for permanent injunction by a plaintiff who does not have any personal interest in the subject matter of the suit was not maintainable and an injunction cannot be granted in favour of such a plaintiff; in the instant case, having regard to the undisputed fact that the plaintiff not being an owner or a licencee or an exclusive licencee of the plaint schedule copyrights clearly does not have any personal interest in the plaint schedule copyrights which were the subject matter of the suit and as such, the instant suit for permanent injunction simpliciter filed by the plaintiff which was an independent, legal and juristic entity, which was mutually exclusive and different from the Producers / members who were the owners of the plaint schedule copyrights was clearly not maintainable and the plaint was liable to be rejected on this ground also. 23. A perusal of the impugned order will indicate that despite having referred to the provisions contained in Sections 54, 55 and

61 of the said Act of 1957 as well as the provisions contained in Section 41(j) of the Specific Relief Act, the trial court has not considered the various aspects of the matter or the contentions urged by the petitioners, thereby resulting in an erroneous conclusion. The trial court also came to the erroneous conclusion that the issue of locus standi, maintainability of the suit and non- joinder of parties would have to be decided only after trial without appreciating that even as per the plaint averments and documents produced along with it, the suit was not maintainable and there was no cause of action for the suit which was liable to be dismissed for the reasons stated hereinbefore. 24.
Under these circumstances, I am of the view that the trial court completely misdirected itself in coming to the erroneous conclusion that the plaint cannot be rejected by improper and erroneous appreciation of the material on record and relevant statutory provisions warranting interference by this Court in the present petitions which deserve to be allowed by setting aside the impugned order and thereby rejecting the plaint filed by the plaintiff. 25. said judgments are not applicable to the facts and circumstances obtaining in the instant case and none of the judgments have been rendered with reference to either Sections 54, 55 or 61 of the said Act of 1957 nor Section 41(j) of the Specific Relief Act as referred to supra and as such, the said judgments cannot be relied upon by the plaintiff in support of its contentions. 26.
