02/09.04.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Jharia P.S. Case No.295/2025, registered for the offence under Sections 126(2), 127(2), 118(1), 109(1), 352, 351(2), 303(2), 3(5) of the BNS, pending in the Court of the learned A.C.J.M., Dhanbad.

Learned counsel appearing for the petitioners submits that false allegations of assault by way of axe are made against the petitioners. He further submits that there is no injury on the back side and that allegation is also against one Pawan Kumar Yadav @ Pawan Yadav. He then submits that the petitioners are doing the work of sweeper and in the heat of the moment, the altercation took place. He next submits that the said Pawan Kumar Yadav @ Pawan Yadav has been granted privilege of anticipatory bail by this Court in A.B.A. No.7553 of 2025. He also submits that the petitioner is having no criminal antecedent, as disclose din paragraph 18 of this application.

Learned counsel appearing for the State opposed the prayer and submits that there is direct allegation against the petitioner.

Considering that the co-accused has been granted anticipatory bail by this Court in the aforesaid A.B.A. and it has been pointed out that at the heat of the moment, the altercation took place and the petitioners are discharging their duties by doing the work of sweeper and in that view of the matter, the petitioners are directed to surrender before the learned Court within a period of two weeks from today and the learned Court shall release the petitioners on such terms and conditions as the learned Court may deem fit and proper.
6. Accordingly, this application is disposed of.
