Heard learned counsel Shri N.D.Jambhule for the petitioner; learned counsel Shri Nikhil Gaikwad for respondent No.2, and learned Assistant Government Pleader Shri Amit Chutke for respondent No.4. 2. Learned counsel for the petitioner submits that caste claim of the petitioner towards “Mana Scheduled Tribe” was submitted to respondent No.4 – The Joint Commissioner cum Vice Chairman, The Scheduled Tribe Certificate Scrutiny Committee, Nagpur (respondent No.4 – Committee) on 20.9.2024. An acknowledgment to that effect is at page No.21 (Annexure-2). He submits that 2 6 wp6569.26.odt almost two years have passed that the caste claim of the petitioner is not yet decided. He also invites our attention to another acknowledgment, which is at page No.46 (Annexure-9). The said receipt_cum_acknowledgment issued by respondent No.2 - The State Common Entrance Test Cell reveals that the petitioner has been admitted to respondent No.1 – Kavi Kulguru Institute of Technology and Science, Ramtek for the course of First Year under Graduate Technical Courses in Engineering and Technology. The aforesaid admission was effected on 4.8.2026. The aforesaid receipt_cum_acknowledgment reveals that the petitioner was admitted under “The Scheduled Tribe Category” and respondent No.2 - The State Common Entrance Test Cell has clarified in the note at the bottom of the aforesaid acknowledgment that candidates belonging to the Scheduled Tribe shall submit their Original Caste Validity Certificates on or before final reporting date of fourth CAP Round, failure to do so will result in automatic cancellation of their admissions. In view of such urgency, the petitioner has approached this court. 3. Learned Assistant Government Pleader for respondent No.4 – Committee, upon instructions, submits that the Committee shall decide the caste claim of the petitioner 3 6 wp6569.26.odt towards “Mana Scheduled Tribe” within a period of two months from today. 4. In view of the above, we dispose of the present writ petition with directions to respondents, as per the order below: ORDER (1) The Writ Petition is disposed of. (2) The respondent No.4 – The Joint Commissioner cum Vice Chairman, The Scheduled Tribe Certificate Scrutiny Committee, Nagpur is directed to decide the caste claim of the petitioner towards “Mana Scheduled Tribe” within a period of two months from today. (3) In the meantime, respondent No.2 - The State Common Entrance Test Cell is directed not to cancel the admission of the petitioner, in view of the note mentioned in the acknowledgment, for want of Caste Validity Certificate, till the decision of respondent No.4 – Committee. (4) The petitioner is directed to co-operate with respondent No.4 – Committee for expeditious decision of her caste claim.
