In the matter of: Palash Das & Anr. …Petitioners
Mr. Sabir Ahmed Mr. Quazi Ezaz Ahmed …for the Petitioners
Mr. Gouranga Kumar Das Mr. Narattam Acharyya … for the State
1. Report submitted by the learned counsel for the State is kept with the record. 2. Heard the learned counsel for the petitioner as well as the learned counsel for the State. 3. It appears that the present petitioners were not named in the FIR. It is further found that the principal accused persons are in custody. The FIR does not disclose anything and further, it appears from the C.D. that the present petitioners are the associates of the principal accused. Investigation has progressed to a considerable extent and nothing has been seized from the present petitioners. As such, I find that there is no need for keeping the petitioners in custody. 4. Accordingly, the application for bail of the petitioners, namely, Palash Das and Prokash Das is allowed. 2
5. I direct the petitioners will be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be a local, to the satisfaction of the learned Chief Judicial Magistrate, Krishnanagar, Nadia. The petitioners shall appear before the learned Trial Court on each and every day of substantive hearing subject to the provisions of Section 317 of the Code of Criminal Procedure, 1973/Section 355 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever. The petitioners shall not enter the jurisdiction of Kotwali Police Station except for the purpose of attending Court and shall furnish their current local address where they shall reside to the learned Trial Court and shall meet the Investigating Officer as and when called for until further orders. 6.
In the event, the petitioner fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. 7. Thus, the application for bail being C.R.M. (M) 2533 of 2026 stands disposed of. 8. All parties shall act on the server copy of this order duly downloaded from the official website of this Hon’ble Court. 9.
