09. 10.2026 The W.B.S.E.D.C.L & Ors. sl.no.12 ct.652 Mr. Rabindranath Mahato Mr. Aritra Shankar Ray ….for the petitioners
Ms. Suvasree Ghose …for the WBSEDCL/Respondent
1. Affidavit of service filed by the petitioners is taken on record. 2. The instant writ petition is directed against the alleged inaction of the respondent authority in providing electricity connection at the shop room in the concerned premises, which the petitioners have purchased for valuable considerations. 3. The petitioners have duly applied for new connection at the said purchased property of them, by duly complying with the statutory formalities and submission of fees. 4. It appears from record that the respondent No. 6 has put up objection towards grant of electricity connection to the shop room of the petitioner. 5. It is further noted that in a proceeding under Section 163 BNSS, the Executive Magistrate, Paschim Medinipur Sadar has directed not to
2 provide any new electric installation connection to the petitioners, without prior approval of the developer. 6. Learned advocate for the petitioners has indicated that such order of the Executive Magistrate, Paschim Medinipur Sadar has been stayed by dint of an order of the learned Sessions Judge, Paschim Medinipur Sadar, dated 17th September, 2026. It is submitted that though it is a limited stay order, the same is in vogue till 13th November, 2026. 7. The Court considers that the petitioner admittedly being the purchaser and owner of the shop room at the concerned premises, is entitled under law for grant of electricity connection, unless to be restrained only in accordance with law. 8. The Courts have time and again determined that way leave permission would not be imperative for grant of electricity connection to a owner or occupier of the premises that being one of the essential services in civil life. 9. Notably the order of the Executive Magistrate, Paschim Medinipur Sadar dated 27th August, 2026 as mentioned above is now stayed by the learned Sessions Judge. The private
3 respondent though has been served with the copy of the writ petition is not represented today, when the matter is taken up for consideration. 10. Taking into consideration all the facts and circumstances as discussed above, this Court of the view that electricity connection to the petitioner cannot be refused or restrained on any pretext excepting that in accordance with law. 11.
Hence, in the present case and on the factual ground as discussed above, the petitioners’ claim for grant of new connection to the property purchased by him cannot be denied on any pretext whatsoever, as put forth so far by the private respondent or the respondent authority. 12. Let therefore, this writ petition be disposed of by directing the respondent authority to immediately grant electric connection to the petitioners’ shop room subject to his fulfilling all necessary statutory formalities and maintaining all safety and security norms, within a period of ten days from the date of communication of this order. 4
13. In doing so, the respondent authority shall be at liberty to take police help, cost of which should be borne by the petitioner. 14. The respondent no. 4 is directed in this regard to extend adequate help to the respondent authority for installation of electricity connection at the premises of the petitioner, if sought for. 15. With the direction as above, the writ petition is disposed of. (Rai Chattopadhyay, J.)
