order dt. 16.11.2022 in Rc.No.85/2021/EGS/HR passed by the 3rd respondent thereby terminated the petitioner from the post of Field Assistant working in Kesavarayunipalem Gram Panchayat in Laveru Mandal of Srikakulam District, without conducting enquiry, without considering petitioner's explanations dt. 27.03.2021, 14.10.2022 and 09.11.2022, without furnishing the Enquiry Report dt. 19.07.2022 of Assistant Project Director, DWMA, Etcherla Cluster and Programme Officer, Laveru Mandal, without considering the Grounds of Appeal and without passing speaking order, as illegal, irregular, arbitrary, violative of principles of natural justice, violative of Field Assistants Human Resource Policy (FAHRP) Annexure to Circular No.666/EGS(P)/2012, dt. 08.01.2013 and provisions of National Rural Employment Guarantee Scheme Act, 2005 and offends Articles 14 and 21 of the Constitution of India and set aside the proceedings dt. 16.11.2022 and 13.02.2023 issued by the respondents 2 and 3 and consequently direct the respondents to reinstate the petitioner into service for the said post and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to suspend the operation of proceedings in Rc.No.85/2021/EGS/HR, dated 16.11.2022 passed by the 3rd respondent as confirmed by order dt. 13.02.2023 in Rc.No.85/2021/EGS/HR passed by the 2nd respondent and consequently direct the respondents 2 and 3 to reinstate the petitioner into service in the post of Field Assistant working in Kesavarayunipalem Gram Panchayat, Laveru Mandal, Srikakulam District, pending disposal of the main writ petition and pass Counsel for the Petitioner:

ORDER
The Writ Petition has been filed by the petitioner challenging the proceedings issued by the 2nd Respondent bearing Rc.No.85/2021/EGS/HR, dated 13.02.2023, thereby rejecting the petitioner's appeal and confirming the
order dated 16.11.2022 in Rc.No.85/2021/EGS/HR passed by the 3rd respondent, whereby the service of the petitioner was terminated from the post of Field Assistant working in Kesavarayunipalem Gram Panchayat, Laveru Mandal, Srikakulam District.
2. At the time of admission, this Court passed an order dated 24.02.2023 granting interim suspension as prayed for. Pursuant to the same, the respondents have reinstated the petitioner vide letter in Rc.No.85/2021/EGS/HR, dated 20.03.2023, and the petitioner is being continued as Field Assistant as on today.
3. Mr. Srinivas Ambati, learned counsel for the petitioner, submits that nothing survives for adjudication in the present Writ Petition.
4. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
