Dileepan for Mr.T.M.Naidu and Co For Respondent(s): Mr.R.Munuswamy https://www.mhc.tn.gov.in/judis CRP No. 3759 of 2026 ORDER This civil revision petition has been filed, challenging the impugned order dated 01.04.2026 passed by the XVII Additional District cum Sessions Court, Chennai in I.A.No.5 of 2026 in O.S.No.191 of 2023. 2. In the aforesaid order, the application filed by the petitioners, who are the defendants in the suit O.S.No.191 of 2023, seeking leave of the trial court to receive the photographs as documents, has been dismissed on the ground that the said photographs are inadmissible evidences. The suit has been filed by the respondents / plaintiffs, seeking for recovery of possession, for arrears of rent and for payment of mesne profit. 3. The petitioners / defendants have disputed the said claim as they claim that they are not tenants of the respondents / plaintiffs. They have already filed the written statement and they have also made a counter claim against the respondents / plaintiffs. After the respondents / plaintiffs filed their proof affidavit, before the trial court for commencement of the trial, the petitioners / defendants filed I.A.No.5 of 2026, seeking leave of the trial court to permit them to file photographs as documents in support of their evidence. The learned counsel for the petitioners also relied upon certain authorities rendered by the constitutional courts in support of his contention that the trial court had committed an error by dismissing the application as the trial court, according to him, ought to have allowed the application by permitting the petitioners to produce the photographs subject to their admission, proof and relevancy. 5. Eventhough, at the outset, the learned counsel for the respondents vehemently opposed the submissions made by the learned counsel for the petitioners, but after quite sometime, the learned counsel for the respondents has now fairly submitted before this Court that the documents filed by the petitioners / defendants may be allowed to be received by the trial court subject to their admission, proof and relevancy. 6. No prejudice would be caused to any of the parties, if a direction is issued to the trial court to receive the photographs produced by the petitioners / defendants and mark them as exhibits on the side of the petitioners / defendants subject to their admission, proof and relevancy. 7. The learned counsel for the respondents / plaintiffs also requested the Court that a direction may be issued to the trial court to dispose of the suit within a time frame to be fixed by this Court. Accordingly, this civil revision petition is disposed of by setting aside the impugned order dated 01.04.2026 passed by the XVII Additional District and Sessions Court, Chennai in I.A.No.5 of 2026 in O.S. No.191 of 2023 by directing the said court to receive the photographs filed by the petitioners / defendants, which is the subject matter of this civil revision petition and mark them as exhibits on the side of the petitioners / defendants subject to their admission, proof and relevancy and the respondents / plaintiffs are permitted to cross examine the petitioners / defendants with regard to the veracity of the said photographs during the time of cross examination. 9. The trial court viz., the XVII Additional District and Sessions Court, Chennai is also directed to dispose of the suit O.S. No.191 of 2023 within a period of one year from the date of receipt of a copy of this order. No costs.
