Learned Counsel for the petitioner submits that although it is not disputed at the hands of respondent No.5-Tahsildar, Belur Taluk, that a grant of 4 Acres of land in Block No.13, Survey No.12 of Honnenahalli Kaval Village, Belur Taluk, Hassan District was made in favour of the petitioner's mother, late Smt.Chikkamma W/o Rudregowda, however, the Tahsildar has not issued Saguvali Chit. Learned Counsel for the petitioner submits that when it is not disputed that Smt.Chikkamma W/o Rudregowda was granted 4 Acres of land consequent to the submergence of her lands for the Hemavathi and Yagachi Reservoir Project, the Tahsildar could not have declined to entertain the representations given by the petitioner for the issuance of Saguvali Chit. 3. There is substance in the submission made by the learned counsel for petitioner. 4. If it is a fact which is borne out from the records that late Smt.Chikkamma W/o Rudregowda was granted 4

Acres of land in Survey No.12 of Honnenahalli Kaval Village, Belur Taluk Hassan District, as she was entitled for such a grant pursuant to the scheme announced by the State Government in favour of persons, who were displaced on account of the Hemavathi Reservoir Project, it is the Tahsildar alone who is required to consider the grievance of the petitioner for issuance of Saguvali Chit. The Saguvali Chit can be issued in the name of the grantee itself. However, when it comes to the mutation of the revenue records, the petitioner can seek to enter her name in the revenue records on the strength of succession. But that is a different matter. As of now, the request made by the petitioner is for issuance of a Saguvali Chit and respondent No.5-Tahsildar, Belur Taluk, is the competent authority for taking action in that regard. 5. Consequently, the writ petition stands disposed of with a specific direction to respondent No.5-Tahsildar, Belur Taluk, to consider the representations given by the petitioner and issue Saguvali Chit in the name of the

grantee as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this order. Ordered accordingly. 6. Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today.
