JUSTICE S.R.KRISHNA KUMAR CAV ORDER In this petition, petitioner-accused No.5 seeks quashing of the impugned proceedings in C.C.No.18547/2025 for offences punishable under Sections 66(c) and (d) of the Information Technology Act, 2000 (for short ‘the said Act of 2000’) and Sections 120B, 109, 411, 420, 465, 467, 468, 471 r/w 34 IPC and for other reliefs. 2. A perusal of the material on record will indicate that pursuant to complaint dated 06.03.2023 lodged by the 2nd respondent – de facto complainant, the 1st respondent – police authorities registered an FIR in Crime No.1/2023 dated 06.03.2023 against Sheik Mahamood – accused No.1 and Moiuddin Papamiyan Patel – accused No.2 for offences punishable under Sections 66(c) and (d) of the said Act of 2000 and Sections 419 and 420 IPC, in pursuance of which, the police authorities conducted investigation and filed a charge sheet in the impugned proceedings - 3 - HC-KAR NC: 2026:KHC:14661 CRL.P No. 9985 of 2025 against accused Nos. 1 to 4 and accused Nos.6 and 7 as well as petitioner – accused No.5, who is before this Court by way of the present petition seeking quashing of the impugned proceedings. 3. Heard learned counsel for the petitioner and learned Addl.SPP for the respondents and perused the material on record. 4. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned counsel for the petitioner submits that the complaint did not contain the name of the petitioner who was not arrayed as an accused person and the investigation officer failed to unearth any concrete corroborative or incriminating evidence directly linking the petitioner to the alleged offences. It was also submitted that in addition to the fact that there was a delay in lodgment of the complaint and vital pieces of evidence viz., alleged POS machine, international cards had not been seized, no specific overt act or role has been attributed to the petitioner in the entire charge sheet nor have any bank statements, call detail records or transactions proofs have been produced to establish the involvement of the petitioner. It was further submitted that the material seized from the petitioner viz., primary mobile phones, sim cards etc., have not been - 4 - HC-KAR NC: 2026:KHC:14661 CRL.P No. 9985 of 2025 demonstrably linked to the alleged criminal activity through any forensic analysis or transactional evidence and the purported recovery of Rs.3 lakhs from the account of the petitioner’s wife was disputed by the petitioner who asserts that it was deposited under instructions from the investigating officer for his release and not as proceeds of crime. He would further submits that the charge sheet has been filed against the petitioner based on voluntary statement of co-accused No.4 which is impermissible in law. It is therefore submitted that the impugned proceedings qua the petitioner deserve to be quashed. 5. Per contra, learned Addl.SPP for the 1st respondent - State submits that the various contentions urged by the petitioner give rise to disputed questions of fact which would necessarily have to be adjudicated upon after trial and the same would lie in the realm of appreciation of evidence by the trial court and not by this Court in the exercise of its jurisdiction under Section 482 Cr.P.C. and as such, there is no merit in the petition and the same is liable to be dismissed. 6. I have given my anxious consideration to the rival submissions and perused the material on record. - 5 - HC-KAR NC: 2026:KHC:14661 CRL.P No. 9985 of 2025 7. Before adverting to the rival submissions, it would be necessary to extract the complaint and FIR which are as under:- Complaint Date:6th March 2023 “To, The Inspector of Police, ___________ Police station, Bangalore. Dear Sir, Sub: Criminal Complaint against M/s. MOPSKM Trading Private Limited for misuse of International cards in the Point of Sale (POS) machine. Kotak Mahindra Bank Ltd is a banking company registered under the Companies Act 1956, having its Registered office at No.27, BKC, C 27, G Block, Bandra Kurla Complex, Bandra (East), Mumbai and having branches spread across the country, including the one at MG Road branch, Bangalore (hereinafter referred to as the “Complainant Bank”). The undersigned is the manager of MG Road Branch, since 15th April 2019. That the present complaint is being filed by the Complainant Bank against M/s. MOPSKM Trading Private Limited registered office at BBG ISHWARYA QUARTZ FLAT NO. F- 4, 1st FLOOR, EAST FACING DOOR, WARD NO.19, Residing AT NO.12 BANGALORE – 560094 represented by its authorized signatories Mr.SHAIK MAHAMOOD & Mr. - 6 - HC-KAR NC: 2026:KHC:14661 CRL.P No. 9985 of 2025 MOIUDDIN PAPAMIYAN PATEL (hereinafter referred to as the “Accused Persons”) for misuse of international cards in the Point of Sale (POS) machine. That the facts of the case in brief is as follows:- The customer M/s. MOPSKM Trading Private Limited had applied for Point of Sale (POS) machine on 29.12.2020 and upon on scrutinizing of the Application and other documents submitted by the Customer, The Complainant Bank had issued POS machine to the customer vide Merchant ID 0798066A0000024, Terminal ID – 0462828A. In the month of January 2023, Bank had observed significant increase in international card usage in the customer’s POS machine. Upon reviewing the merchant transactions made in the Bank’s POS machine was observed that 130 international card transactions were made during the period 28.12.2022 to 09.01.2023. it was further observed that merchant had used 10 different international currency cards (debit & credit cards). The merchant had made total transaction amounting of Rs.1.96 crores during the above mentioned period. The card usage payments were already settled/credited to the customer’s current account no.5045180717 on the subsequent day of transactions. The funds from the customer account has been withdrawn. Subsequently, the Complainant Bank had received multiple Chargebacks from the card issuing Banks for the transactions made in POS machine. Customer/merchant was - 7 - HC-KAR NC: 2026:KHC:14661 CRL.P No. 9985 of 2025 unable to provide document proof for the international card transactions made in his POS machine, Sufficient balance was not available in the customer account to debit the amount towards the chargeback received. Based on the suspected transactions and customer’s settlement of Rs.22,58,000 for the transaction dated 09.01.2023 was kept on hold. A copy of the account opening application and international card transaction details are enclosed herewith as Annexure-A. In light of the above findings, the Complaint Bank States that, the accused person M/s. MOPSKM Trading Private Limited has fraudulently misappropriated/misused international customer’s Debit & Credit cards in the POS machine issued by the Complainant Bank and the said accused person had siphoned of the amount aggregating to Rs.1.70 crores. The customer/accused person is not contactable at the registered address. Further, the Accused person has committed such acts on an ongoing/continuing basis and present circumstances are axiomatic of the fact that the intention of the Accused person was malafide from the very beginning and no negligence or lack of knowledge can be attributed to him as the present case pertains to huge amount of funds. Accordingly, the said acts of the Accused person are culpable and incriminating and amount to cheating, criminal breach of trust and criminal misappropriation of property. The Complainant Bank states that, customer/accused person had defraud the Complainant Bank and Bank had incurred loss regarding the same. The cause of action to entertain the present criminal complaint had arisen at the above branch address which is within the territorial jurisdiction of the Ld. Officer. Accordingly, the Complainant Bank requests the Ld. Officer to investigate the matter and proceed as per law. We assure to provide all the co-operation required in the investigation. Road branch since Dt:15.04.2019. The customer M/s MOPSKM Trading Private Limited represented by its authorized signatories 1) Mr. Shaik Mahamood, 2) Moiudduin Papamiyan Patel had applied for Point of Sale (POS) machine on 29-12-2020 and the complaint bank issued POS machine to the customer vide Merchant ID-0798066A0000024, Terminal ID-0462828A. in the month of January 2023 complainant bank observed significant increase in International card usage in the POS machine issued to M/s MOPSKM Trading Private Limited. The complainant bank had received multiple charge backs from the card issuing banks for the transactions made in POS machine. Accused/Customer was unable to provide document proof for the International card transactions made in his POS machine. Complainant states that accused person M/s MOPSKM Trading Private Limited has fraudulently misappropriated International customer’s Debit & Credit cards in the POS machine issued by the complainant Bank and the accused person had siphoned of the amount aggregating to Rs.1.70 crores. A perusal of the aforesaid material on record including the statements of the witnesses cited in the charge sheet and its summary will indicate that the legality, validity, correctness, veracity etc., of the allegations made against petitioner – accused No.5 give rise to disputed questions of fact which would necessarily have to be decided by the trial court, either while considering a discharge application (if filed) by the petitioner or after trial to be conducted by the trial court; in other words, the prima facie material on record indicates that this not a fit case for this Court to exercise its jurisdiction under Section 482 Cr.P.C and quash the impugned proceedings without providing an opportunity to the 1st respondent – prosecution in this regard; at any rate, since it is always open for the petitioner to urge all contentions before the trial court by filing appropriate discharge application, I am of the considered opinion that the present petition deserves to be disposed of without interfering with the impugned proceedings and by reserving liberty - 18 - HC-KAR NC: 2026:KHC:14661 CRL.P No. 9985 of 2025 in favour of the petitioner to file an appropriate discharge application which shall be considered and disposed of by the trial court (if charges are not already framed as on today) in accordance with law. 10. 10.
