Case No.1587 of 2025 dated 12.12.2025 under Sections 126(2)/118(2)/109/3(5) of the BNS, 2023. And In the matter of: Subham Saha … petitioner Ms. Sananda Bhattacharyya … for the petitioner Mr. Prasun Kumar Dutta Mr. Abhishek Verma … for the State Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is a student. He was earlier granted interim relief, so that he could appear in the Higher Secondary Examination. The same is over now. Learned counsel for the State opposes the prayer for anticipatory bail and relies on the statements of the victim and other witnesses and the injury report. The prosecution case is that the petitioner drove his toto recklessly over a dog. The dog was severely injured, number of teeth came out. When the victim saw this, he protested. Then the petitioner started abusing him, went inside the victim’s house and assaulted him severely with an iron rod. The petitioner’s name is mentioned as the assailant. Among other things, the injury report shows a lacerated wound on a 2 vital part of the body like scalp that required stitches for repair. Considering the above, the allegation of series of illegal acts as alleged against the petitioner, the other incriminating materials available in the case diary and the brazen nature of the assault on the present victim, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
