For Petitioner(s): Mr.T.Karkkivelan For Respondent(s): Ms.S.Pavithra Standing Counsel https://www.mhc.tn.gov.in/judis WP No. 26511 of 2026 __________ Page2 of 5 Order This writ petition is filed for a mandamus directing the respondent to revise the petitioner’s salary from the date of reinstatement i.e 26.03.2026 by taking note of increment, intervening settlement benefits and periodical review benefits for the non employment period from 27.10.2020 to 26.03.2026. 2. The petitioner joined the respondent Transport Corporation as a Conductor on 21.07.2000. He was terminated from service on 27.10.2020. The approval petition in A.P.No.187 of 2020 filed by the respondent before the Joint Commissioner of Labour was rejected on 17.10.2022. Challenging the same, the petitioner filed W.P. No.4887 of 2024, and this Court, by order dated 14.08.2025, directed the respondents to reinstate the petitioner with continuity of service, but without back wages. Pursuant thereto, the petitioner was reinstated on 26.03.2026. 3. According to the petitioner, after reinstatement, the respondents did not fix his wages by taking into account the continuity of service and the applicable wage revision, resulting in the fixation of a lower basic pay. https://www.mhc.tn.gov.in/judis WP No. 26511 of 2026 __________ Page3 of 5 The petitioner submitted a representation dated 13.05.2026 requesting refixation of his wages. Since no action has been taken on the said representation, the petitioner has filed the present writ petition seeking appropriate relief. 4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for respondents. 5. Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the respondent to consider the representation of the petitioner dated 13.05.2026 seeking revision of his salary from the date of his reinstatement into service and pass appropriate orders on merits and in accordance with law if the petitioner is found eligible, within a period of twelve weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 26511 of 2026 __________ Page4 of 5 6.
