For Petitioner(s): in all W.Ps Mr. C.Venkatesan For Respondent(s): in all W.Ps Mr.A.R.Balaji Government Advocate- R1,3 to 5 Mr.V.Vijay Shankar Standing Counsel - R2 Common Order These writ petitions have been filed seeking to issue a writ of mandamus directing the respondents to count 50 percent service rendered in the post of noon meal organizer from 05.02.1983 to 05.02.1993 along https://www.mhc.tn.gov.in/judis WP No. 26700 of 2026 __________ Page3 of 6 with regular service for the purpose of granting pension as per G.O.M.S.No.408 Finance pension department dated 25.08.2009 based on the petitioners’ representation dated 04.05.2026. 2. The petitioners were appointed as Noon Meal Organiser on 05.02.1983. Their services were terminated on 17.04.1985, which was challenged before this Court in W.P.No.5093 of 1985. By order dated 10.11.1992, this Court set aside the order of termination. Thereafter, the petitioners joined Government service on 21.07.1993 and retired from service on 30.06.2016. According to the petitioners, in terms of G.O.Ms. No.408, Finance (Pension) Department, dated 25.08.2009, 50% of his earlier service from 05.02.1983 to 10.11.1992 is liable to be counted for pensionary benefits. The petitioners submitted representations, lastly on 04.05.2026 and 14.05.2026, requesting the respondents to extend the said benefit. Since no orders have been passed on the representation, the petitioners have filed the present writ petition seeking a direction to the respondents to consider the same. 3. With reference to the petitioners in W.P.No.26700 and 26705 of 2026, it is seen that their requests have already been rejected by the respondents vide proceedings dated 20.12.2024. Without challenging the said rejection orders, the petitioners have filed these writ petitions seeking for the very same relief. 5. With reference to the petitioner in W.P.No.26708 of 2026, it is seen that his request has already been rejected vide proceedings dated 19.05.2026 on the ground that he has to approach the department in which earlier he had served. The said rejection order has not been challenged. 6. Since the earlier rejection orders have not been challenged, the present writ petitions are not maintainable. Accordingly, these writ petitions are dismissed.
