In the matter of : Mohammad Ali @ Lattu Miah
… Petitioner(s)
Mr. Kaushik Choudhury
… for the petitioner(s)
Mr. Sourabh Sundar Shee Ms. Aishwarya Madhushree
… for the State-respondent(s)
Learned advocate for the petitioner submits that the petitioner has been implicated only on the basis of statement of a co-accused although there has been alleged recovery of 58 bottles of cough syrup from other accused persons. State opposes the prayer for anticipatory bail. However, it has been submitted on behalf of the State that there are no antecedent of the present petitioner and/or CDR and/or money trail between the petitioner and the other accused persons.
2 Having considered the same, I am inclined to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Mohammad Ali @ Lattu Miah] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita,
2023. As charge sheet has been submitted, this order of anticipatory bail will remain valid for a period of six weeks from date. Accordingly, CRM (A) 3775 of 2026 is disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
