1. Mr. Lalit Sharma, learned counsel for the petitioner.
2. Mr. Tumul Nainwal, learned AGA for the State.
3. Ms. Suraiya Naaz, learned counsel for the complainant.
4. The instant writ petition has been filed by the petitioner for quashing of the FIR dated 06.12.2025 bearing FIR No. 0394 of 2025 registered at Police Station – Sitarganj, District – Udham Singh Nagar wherein petitioner has been implicated for the offence punishable under Section 318 (4) of BNS, 2023.
5. The instant writ petition has been field along with compounding application supported with the affidavit of petitioner and respondent no. 3.
6. Petitioner and respondent no. 3 are present in person before this Court and they are duly identified by their respective counsel through their adhar card and this Court also interacted with them.
7. Both the parties have submitted that they have settled their dispute amicably and they do not want to proceed further with the matter. Respondent no. 3 / the complainant submits that she do not want to pursue with the impugned FIR.
8. Mr. Tumul Nainwal, learned AGA for the State, submits that if the parties have settled their dispute, there is no useful purpose to go with the investigation and even otherwise, offence is compoundable.
9. In view of the above, writ petition as well as compounding application are allowed. Consequently, impugned FIR qua the petitioner is hereby quashed.
