Crl.O.P.No.18020 of 2026
ORDER The First Information Report in Crime No.1350 of 2021 is sought to be quashed.
2. On the allegation that there was a threat, abuse and also hurling the petrol bomb and attack, the F.I.R was registered for the alleged offences under Sections 294(b), 307, 385 of I.P.C and Section 9(B)(1)(b) of the Indian Explosives Act, 1884. The primary ground, on which, the F.I.R is sought to be quashed is that no investigation has been proceeded and in a case of this nature, the F.I.R is pending for the past five years. It is further submitted that the petitioner and the second respondent are related to each other and it was only a wordy quarrel and the complaint was given with due embellishment.
3. As far as the pendency of investigation is concerned, the grievance can be redressed by directing the respondent Police to complete the investigation and file a Final Report within a given time. As far as the second ground, that it was a wordy quarrel, is concerned, the same is factual in nature and can be raised during the course of trial. 2/4 https://www.mhc.tn.gov.in/judis
