ORDER This Civil Revision Petition has been filed, challenging the impugned
order dated 16.09.2025 passed by the Sub Court, Bhavani in I.A. No. 12 of 2025 https://www.mhc.tn.gov.in/judis
CRP No. 1823 of 2026 in O.S. No. 60 of 2015.
2. In the aforesaid order, the application filed by the defendants 4 and 5, seeking leave of the trial Court to file additional written statement has been dismissed on the ground of delay on the part of the petitioners to file such an application. Admittedly, the written statement filed by the defendants 4 and 5 was taken on file by the trial Court earlier. After a lapse of four years from the date of filing of the written statement, the petitioners, who are the defendants 4 and 5, filed I.A. No. 12 of 2025, seeking leave of the trial Court to file an application for additional written statement to incorporate additional facts.
3. The suit has been filed for partition by the respondents/plaintiffs in the year 2015. It is also brought to the notice of this Court by the learned counsel appearing for the respondents/plaintiffs that, earlier, the defendants 4 and 5 had filed an amendment application, seeking to amend the written statement, which was dismissed by the trial Court, and only thereafter, they have filed I.A. No. 12 of 2025, seeking leave of the trial Court to file additional written statement.
4. The trial Court has taken into consideration all the aforesaid facts and has rightly dismissed the application filed by the defendants 4 and 5, seeking leave of the trial Court to file additional written statement on the ground of https://www.mhc.tn.gov.in/judis
CRP No. 1823 of 2026 inordinate delay.
5. This Court does not find any infirmity in the reasons given by the trial Court for dismissing the application. Accordingly, this Civil Revision Petition is dismissed.
6. Since the suit is pending from 2015 onwards, this Court directs the Sub Court, Bhavani to dispose of the suit O.S. No.60 of 2015 within a period of one year from the date of receipt of a copy of this order. No costs.
