And In the matter of : Ashis Mondal
……Petitioner. Mr. Sumanta Chakraborty Ms. Dhimoyee Kundu Ms. Tanisha Parua
.....for the Petitioner.
Mr. Kallol Mondal, Ld. PP Mr. Sayak Chakraborti Ms. Supriti Sarkhel
……for the State.
Learned advocate appearing for the petitioner submits that the victim is aged about sixteen and half years and the present petitioner is about 35 years of age, petitioner claims of having a relationship with the victim. State opposes the prayer for bail, produces the Case Diary and draws the attention of the Court to the statement under Section 183 of BNSS. I have taken into account the overall circumstances and I am of the opinion that it would not be fit and proper to release the petitioner on bail prior to the evidence of the victim being completed.
2 As charge-sheet has already been submitted, learned trial Court would expedite the process of consideration of charges as well as the evidence of the victim. At this stage, prayer for bail of the petitioner in CRM (M) 2590 of 2026 is dismissed. Memo of evidence and the report in respect of service submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
