In Re: An application for anticipatory bail under Section 482 of the BNSS,

In connection with Raghunathganj P.S case no. 450 of 2025 dated 9/4/2025 under sections 191(2)/191(3)/190/326/221/132/121(1)(2)/109 of the BNS. In the matter of: Md. Korim @ Mohammad & Ors. ...Petitioners. Mr. Baibhav Roy …for the petitioners. Mr. Soumik Ganguly Ms. Rajnandini Das …for the State.
1. Heard the learned counsels for the parties.
2. Perused the case diary.
3. The prosecution case is that the petitioners are protesting against the Waqf Act and in the process caused damaged to properties and injuries to individuals. However, there is no injury report present in the case diary.
4. Considering the above and the other materials available in the case diary and the fact that a charge-sheet has been submitted, I do not think that custodial interrogation of the petitioners is required in this case and I am inclined to grant anticipatory bail to the petitioners.
5. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local,

to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall not threaten or intimidate the witnesses. The petitioners shall surrender before the jurisdictional Court and pray for bail within four weeks from date and regularly attend the jurisdictional Court.
6. Accordingly, the application for anticipatory bail is allowed.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
