15.10.2026 35. BD CRR 4617 of 2026 M/s. Chain Investments Ltd. Vs. Amit Kumar Jhawar & Anr. Mr. Apalak Basu Mr. Nazir Ahmed …for the Petitioner In this application the petitioner has prayed for a direction upon the court below for expeditious disposal of the proceeding being C/19587/2013 under sections, 138/141 presently pending before learned Judicial Magistrate, 8th Court, Calcutta. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned counsel for the petitioner submits that the recording of evidence of PW1 started in the year 2023. Thereafter, the accused/opposite party complainant preferred an application seeking discharge which was turned down by the trial court. Being aggrieved by that order the accused/opposite party no.1 preferred one revisional application before this Court being CRR 201 of 2025. He further submits that though stay order has not been granted in the said revisional application by this High Court but the court below is fixing dates one after another under the heading “Awaiting order from the High Court”. In this context learned counsel for the petitioner has drawn my attention to the Notification of this High Court 2 Vide No. 4904-RG dated October, 17, 2012 which clearly states that the Judicial Officers will not adjourn any matter simply because connected application is pending before the Hon’ble High Court unless and until stay order is granted by the Hon’ble High Court. He further pointed out that this High Court by an order dated 30th April, 2015 passed in CRR 647 of 2015 has directed the trial court to make expeditious disposal of the proceeding and to conclude the same within four months from the date of communication of this order. It is submitted that such order was duly communicated to the court below but he has not complied with the same. In such view of the matter, the petitioner prays for necessary direction. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with. Having considered the facts and circumstances of the case the instant application being CRR 4617 of 2026 is hereby disposed of with a direction upon the court below to go for day to day trial if possible and he shall not adjourn the matter unless and until any stay is granted by this Court and thereby he will make his best endeavour to 3 conclude the entire proceeding preferably within a period of four months from the date of communication of this order. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
