3. The present criminal misc. application has been filed by the applicant seeking a direction to expedite the proceedings of Criminal Case No. 566 of 2023, State Vs. Gurpreet Singh @ Gopi and Another, pending in the Court of learned Judicial Magistrate, Jaspur, District Udham Singh Nagar.
4. In this case, applicant has lodged the FIR under Section 147, 148, 326 and 506 of IPC against the respondent nos. 2 and 3. After investigation, chargesheet was filed on 10.07.2023 under the 326, 506 and 34 of IPC and thereafter, cognizance was taken on 22.07.2023 and the trial commenced. As per the chargesheet, there are 12 prosecution witnesses, but, till date, five prosecution witnesses have been examined.

Learned counsel for the applicant would submit that even after a lapse of three years when cognizance was taken, only three prosecution witnesses have been examined till date and applicant is an NRI and he is facing difficulty in coming to India in a short notice for pursuing this case. Learned counsel for the applicant would further submit that respondent nos. 2 and 3 are deliberately prolonging the proceedings of the case and the prolonged pendency of the trial is causing
continuous uncertainty and hardship to the applicant. Thus, it would be expedient if the trial is concluded expeditiously. Hence, a direction for expeditious disposal of the case has been prayed for.
6. Having considered the
submissions advanced by learned counsel for the applicant and also considering the fact that cognizance was taken in the year 2023, this Court is of the view that the interest of justice would be served by directing the trial court to expedite the proceedings.

Accordingly, the present criminal misc. application is disposed of with a direction to the court concerned to make all possible endeavours to conclude the proceedings of Criminal Case No. 566 of 2023, State Vs. Gurpreet Singh @ Gopi and Another, pending in the Court of learned Judicial Magistrate, Jaspur, District Udham Singh Nagar, as expeditiously as possible, preferably within a period of one year from the date of production of a certified copy of this order, without granting unnecessary adjournments to either party.
8. Pending applications, if any, shall stand
disposed of accordingly.
