2.
Learned counsel appearing for the petitioner would submit that the petitioner had sustained head injury in a road traffic accident dated 26.12.2012 involving the tractor owned by respondent No.2 and insured by respondent No.3. It is submitted that the Tribunal has awarded a sum of Rs.8,500/- towards the injuries suffered by the petitioner and the said compensation is abysmally low and there is a need for enhancement of the same.
3. Per contra, learned counsel appearing for the respondent No.3 submits that the compensation awarded by the Tribunal is proper and adequate.
4. The fact that there was an accident and the respondent No.2-Insurance Company is liable to pay the compensation is not disputed. Therefore, on perusal of Ex.P7-Wound Certificate which shows that she had suffered an injury that is an irregular contusion on her forehead and the Medical Officer had opined that it is a simple injury. However, she had undergone diagnostic tests, for which, she had spent Rs.3,500/- and therefore,

the Tribunal awarded a sum of Rs.8,500/- to her. It is pertinent to note that apart from the diagnostic tests for which she spent Rs.3,500/-, it could be said that she also spent for conveyance and therefore, it would be just and proper to award a sum of Rs.5,000/- towards 'conveyance expenses', a sum of Rs.5,000/- towards 'loss of income during laid up period'. Therefore, in addition to the compensation awarded by the Tribunal, it would be proper to award a sum of Rs.10,000/- to her. Hence, the following:
ORDER
(i) Appeal is allowed in part.
(ii) The impugned judgment and award passed by the Tribunal in MVC.No.183/2013 is modified by awarding a sum of 10,000/- in addition to what has been awarded by the Tribunal together with interest at 6% p.a. from the date of petition till its deposit.
