JUSTICE ASHOK KUMAR JAIN Order 12/03/2026 1. Instant writ petition is preferred by petitioners with following prayer: “S.B. Civil Writ Petition No. 4628/2026 : It is, therefore, prayed that this writ petition may kindly be accepted and allowed and by an appropriate order or direction, the impugned order dated 03.01.2025 passed by the disciplinary authority as well as the order dated 02.02.2026 passed by the appellate authority may kindly be quashed and set aside and the respondents may kindly be directed to exonerate the petitioner from the charges leveled against him. S.B. Civil Writ Petition No. 17436/2024 : It is, therefore, prayed that this writ petition may kindly appropriate order be accepted and allowed and by an or direction, the impugned order dated 09.02.2021 passed by the disciplinary authority as well as the order dated 07.02.2024 passed by the appellate authority may kindly be quashed and set aside and the respondents may kindly be directed to exonerate the petitioner from the charges leveled against him, and the petitioner be given arrears alongwith interest 12% р.а.” 2. Learned counsel for petitioner while referring and relying upon judgment dated 04.03.2025 in S.B. Civil Writ Petition No16524/2024 titled as Vinod Kumar Solanki Vs. State of Rajasthan submits that the controversy and the issue raised herein is already settled by a Co-ordinate Bench of this Hon’ble Court on the basis of ratio laid down in [2026:RJ-JP:10366] (3 of 4) [CW-4628/2026] case of Rajendra Prasad Sharma Vs. State of Rajasthan and Ors. SB CWP No.20867/2012 decided on 12.08.2024, Shailendra KUmar Bhat Vs. State of Rajasthan SB CWP No.2250/2013 decided on 20.05.2013 and Dharamveer Vs. State of Rajasthan and Ors. reported as 2005(5) RDT 1219. He further submitted that instant writ petition be disposed of in accordance with aforesaid order. 3. Having considered the submissions of learned counsel for petitioner and also material placed on record, the writ petition may be disposed in light of Vinod Kumar Solanki Vs. State of Rajasthan (supra), Rajendra Prasad Sharma Vs. State of Rajasthan and Ors. (supra) Shailendra KUmar Bhat Vs. State of Rajasthan (supra) and Dharamveer Vs. State of Rajasthan and Ors. (supra). 4. Accordingly, the writ petition is disposed of in terms of ratio laid down in case of Vinod Kumar Solanki Vs. State of Rajasthan (supra), Rajendra Prasad Sharma Vs. State of Rajasthan and Ors. (supra) Shailendra KUmar Bhat Vs. State of Rajasthan (supra) and Dharamveer Vs. State of Rajasthan and Ors. (supra). The respondents are at liberty to verify veracity of the facts before extending the same benefits to the petitioners. 5.
