Sakthivel For Respondent(s): Ms. S.Pavithra Standing Counsel for R1 and R2 Order The Writ Petition has been filed seeking to issue a writ of Mandamus directing the respondents to pay interest of 12 percent to the petitioners for belated payment of Gratuity, Dearness Allowance, Leave Salary, Provident Fund and Commutation of pension amounts within a time frame to be fixed by this Court. 2. The case of the petitioners is that they retired from the respondent- Transport Corporation on 30.04.2025, 31.05.2025, 31.10.2024, 31.03.2025 and 31.05.2025 respectively. However, the terminal benefits have been settled to the petitioners only on 11.03.2026, but no interest has been paid for the delayed https://www.mhc.tn.gov.in/judis WP No. 26540 of 2026 __________ Page3 of 5 period. Therefore, the petitioners had submitted representations to the respondents dated 22.06.2026 and 29.06.2026 requesting then to pay interest for the delayed period. Since the said representations were not considered, the present writ petition has been filed. 3. The learned Standing Counsel for the respondent would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount. 4. Heard the learned counsel for both sides and perused the materials available on record. 5. In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners within a period of six weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 26540 of 2026 __________ Page4 of 5 6.
