Shukla, A.P.P. ------ 03/ 06.04.2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Gumla (Mahila) P.S. Case No. 27 of 2025, registered for the offence under Sections 127(2), 115(2), 69, 318(4), 351(2) and 352 of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Sub-Divisional Judicial Magistrate, Gumla. 3. Learned senior counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case. He next submits that the informant is aged about 32 years and in the FIR itself, she has disclosed that she has remained along with the petitioner as a husband and wife for last 2 ½ years. He further submits that the false allegations are made of establishing the relationship on the false pretext of marriage. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of establishing the physical relationship with the informant on the false pretext of marriage. In the FIR itself, it has been stated by the informant herself that she has remained along with the petitioner as a husband and wife for last 2 ½ years and thereafter the FIR has been lodged and informant is said to be 32 years old and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
