1. Heard Mr. K.P. Sahu, learned counsel for the petitioners. Also heard Mr. Shailendra Sharma, learned Panel Lawyer for the respondent / State. 2. The petitioners have filed this petition praying for following relief:-
“1. That, Hon'ble Court may kindly be pleased to allow the instant petition under section 528 of B.N.S.S. 2023 filed by the petitioner, in the interest of justice. 2. That, Hon'ble Court may kindly be pleased to quash the FIR bearing No. 51/2025 registered on dated 28.04.2025 at police station Nandghat, District Chhattisgarh filed under section 85, 3(5) of B.N.S. in the interest of justice. Bemetara
3. That, Hon'ble Court may kindly be pleased to quash entire charge sheet dated 13.10.2025 before learned Judicial Magistrate First Class Katghora District Bemetara Chhattisgarh under section 85, 3(5) of B.N.S. in the interest of justice. 4. That, Hon'ble Court may kindly be pleased to quash the impugned criminal proceeding as Criminal Case No. 6248/2025 before the learned Judicial Magistrate First Class Bemetara Katghora District Bemetara Chhattisgarh in respect of case of the petitioners, in the interest of justice
5. That, Hon'ble Court may kindly be pleased to quash framing charge dated 12.12.2025 against the petitioners, in the interest of justice. 6.
That, the Hon'ble Court may kindly grant any
3 other reliefs in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, in the interest of justice.”
3. It is pointed out by the Registry that the requisite court fee has not been paid in the present petition. 4. Further, learned State counsel submits that although the matter arises out of a matrimonial dispute, the husband of the complainant/respondent No.4 has not been impleaded as a party respondent. 5. In view of the same, learned counsel for the petitioner pray to withdraw the present petition with liberty to file afresh. 6. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh, subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court and the same shall be transmitted to the Government Multi Handicapped Special School, Bagbahra, District- Mahasamund (C.G.), for wasting the precious time of this Court. 7. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same, subject to deposit of the fine amount.
