For Petitioner : Mr.Karthikeyan Sekar For Respondents : Mr.M.Mohamed Riyaz, Government Advocate (Criminal Side), for R1 1/5 https://www.mhc.tn.gov.in/judis Crl.O.P.No.17962 of 2026 ORDER This Criminal Original Petition is filed with a prayer to quash the F.I.R in Crime No.98 of 2026 which is registered for the offences under Sections 318(2) and 336 of B.N.S. 2. Upon reading of the complaint, it is the case of the second respondent that through LinkedIn, the petitioner contacted the second respondent and conducted an online interview. Thereafter, she was given an appointment order by promising a salary of Rs.2,91,667/- and was directed to work from home. After extracting work for many days and even though no salary was credited, the petitioner is said to have sent a challan, by which, he claimed that he had deposited Rs.1,50,000/- into the account of the second respondent. However, the amount was not credited. The same modus operandi was followed by the petitioner with reference to the other victims. In view thereof, the complaint was lodged and the same was registered. 3. Learned Counsel for the petitioner would submit that the second respondent worked for 15 days and thereafter, she did not turn up and employment dispute cannot be given a criminal colour. The contentions made by the learned Counsel for the petitioner are factual in nature and cannot be said to be incontrovertible facts, to considered at the stage of quashing the F.I.R itself. When the allegations make out cognizable offences, the F.I.R has been registered. When the same modus operandi is said to have been followed with reference to three employees, I am of the view that the registration of the case and investigation itself cannot be faulted. It will be open for the petitioner to place on record before the Investigating Officer any information, if he chooses to or he can take all such defences, taken before this Court, during the course of trial. 5. With such liberty kept open, the prayer sought for, as such, cannot be countenanced and this Criminal Original Petition stands disposed of.
