(NS) No. 394 of 2026 arising out of Bowbazar PS Case No. 102 of 2026 dated June, 9, 2026 u/s 316(2)/318(4)/336(2)/ 336(3)/338/340(2)/61(2) of the BNS. -And- In the matter of : Madhuchhanda Sen &Ors. … Petitioner(s) Mr. Jishnu Saha, Sr Adv. Mr. Ayan Poddar Mr. Soham Dutta Mr. Shounak Mondal Ms. Gargi Mukhopadhyay … for the petitioner(s) Mr. Rajdeep Mazumdar, ld. AAG Mr. Kallol Mondal, PP Mr. Aditya Tiwari Mr. Moyukh Mukherjee Mr. Sayan Mukherjee Mr. Koustav Lal Mukherjee … for the State-respondent(s) Mr. Atanu Ghosh … for the defacto-complainant 1. Petitioner no.1 is the wife of Indranil Sen who during the check period was the Minister of Information and Cultural Affairs, Government of West Bengal and also holding the different portfolios on behalf of the Government, either as a Minister or in the statutory bodies. 2 2. Petitioner no.2 is the Secretary of Mahanirban Road Mass Art Society (in short, Mass Art) and also associated with Managing Director/Director of Bridging Brands Private Limited and a partner of Third Line Creation. 3. As has been dealt with in CRM (A) 1704 of 2026, the prosecution’s case has a changed dimension pursuant to the investigation proceeding and relates to misuse of office by Indranil Sen and his associates relating to funds having been siphoned to the account of Indranil Sen and his family members wherein Mass Art has been shown to be a shell entity or an entity created for routing money. Prima facie, the prosecution’s case, at this stage, reflects that it is the Minister who had engineered the scheme of things. As such, going by the materials collected till date, I am of the opinion that custodial detention of all the accused persons are not necessary. 4. Petitioner no.1 is a lady and is the President of Mass Art Society. Petitioner no.1 being a lady the scheme of things were not engineered by her, although she happens to be a President, as such, I am inclined to allow her prayer for anticipatory bail. 5. So far as the petitioner no.3 is concerned he is Treasurer of Mass Art Society and one of the partners of Third Line Creation. The summary of his actions, in the aforesaid process was organizing the allegedly unauthorized preview shows, ticket sales and commercial donor passes are concerned. 3 Other overt acts presently are not surfacing so far as petitioner no.3 is concerned. As such, the prayer for anticipatory bail of petitioner no.3 is allowed. 6. So far as the petitioner no.2 is concerned, he is the Secretary of Mass Art Society, Managing Director and Director of Bridging Brands Private Limited and one of the partners of Third Line Creation. So far as the materials collected against him are concerned, there are overt acts particularly with regard to creating a mask to the proceeds of crime being diverted into a non-profitable institution, movement of money as well as continuously participating in tenders being awarded from the Information and Cultural Affairs Ministry, Government of West Bengal. His association with the Minister has generated funds in deviation of the Government Rules and Procedures and enriched both the said Dhrubajyoti Bose and Inranil Sen. Consequently, the prayer for anticipatory bail of petitioner no.2 [Dhrubajyoti Bose] is hereby rejected. 7. Accordingly, I direct that in the event of arrest, the petitioner no.1 viz. Madhuchhanda Sen and petitioner no.3 viz. Ranjan Chatterjee be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4 8. Petitioner nos. 1 and 3 would make themselves available as and when required by the Investigating Agency. Accordingly, CRM (A) 1706 of 2026 is partly allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
