The records would show that the petitioner is the legally wedded wife of the deceased R.Subramani, who had retired from service on attaining the age of superannuation on 30.06.2003 and had passed away on 20.05.2024. The deceased Subramani had nominated the petitioner as his wife in the service register for the purpose of family pension. The petitioner has provided all the required documents for the sanction of family pension in her favour. The petitioner’s husband had a relationship with one Revathi and the said Revathi had moved this Court in W.P.No.239 of 2018 seeking a mandamus directing the respondents to grant pension to her. This Court, vide order dated 08.01.2018, had also directed the 5th respondent herein to consider and pass orders within a period of four weeks. The 5th respondent had addressed the 3rd respondent herein about the fact that in the service register, the deceased Subramanian had nominated the petitioner as his wife for getting the family pension. This communication has been sent as early as on 08.11.2018. It is thereafter that the Memorandum of Compromise had been entered into between the petitioner and the said Revathi acknowledging the fact that the petitioner should be granted the family pension. Under this Memorandum of Compromise both of them agreed to share the family pension. Thereafter, the said Revathi had passed away on 04.10.2024. This being the case and in the absence of any order of a competent Court prohibiting the release of family pension in favour of the petitioner, there is no explanation as to why the petitioner’s request has not been considered to date. The respondents have failed to discharge the statutory duties cast upon them. 4. In view of the facts and circumstances of the case, the writ petition is allowed and a mandamus is issued to the 5threspondent to sanction and disburse the family pension in favour of the petitioner, being the legally wedded wife of late Subramani along with all consequential arrears payable from the date of entitlement on or before 31.07.2026 failing which contempt proceedings will be initiated against the 5th respondent. 5.
