.....for the Petitioners.
Mr. Brajesh Jha Ms. Sanjana Jha
……for the State.
Learned advocate appearing for the petitioners submit that petitioners are in custody for almost five months. Learned advocate appearing for the State opposes the prayer for bail as there are overt acts of the present petitioners in inflicting the injuries. Although, the conduct of the petitioners cannot be approved, however, considering the detention of the present petitioners, I am of the opinion that on stringent conditions petitioners be released on bail. Accordingly, prayer for bail of the petitioners is allowed. As such, the petitioners namely, Akibul Sekh @ Saikh; (2) Sajibul Shaikh @ Sajhi Sekh and (3) Basibul Saikh shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten
2 Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Krishnagar, Nadia. If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Nadia without prior permission of the learned Trial Court. Additionally, petitioners shall stay outside the jurisdiction of Kotwali police station and until and unless the condition is modified by the learned Trial Court after the vulnerable witnesses are examined. With the aforesaid observations, CRM (M) No. 2640 of 2026 is allowed. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
