Mr.D.A.Sugumar, learned counsel for the Petitioner submits that this Criminal Miscellaneous Petition has been filed under Section 5 of the __________ Page1 of 4 https://www.mhc.tn.gov.in/judis CRL MP No. 6638 of 2026 Limitation Act, 1963, seeking to condone the delay of 108 days in filing the Criminal Revision Petition. 3. Mr.Yuva Prasanna, learned counsel appearing for the Respondent has stated that he has no objection in allowing this petition, subject to the condition that the petitioner may deposit atleast 50% of the total cheque amount viz., Rs.16,00,000/-. 4.The learned counsel for the petitioner submitted that his client is ready to bring the Demand Draft of Rs.8,00,000/-, being 50% of the total cheque amount within a week from today. He also prayed that the suspension of sentence application shall also be considered. 5.In view of the reasons stated in the affidavit filed in support of the condone delay petition which appears to be convincing and genuine and the assurance given by the learned counsel for the petitioner that the petitioner will bring a Demand Draft for a sum of Rs.8,00,000/-, which is the 50% of the total cheque amount within a week and recording the no objection given by the learned counsel for the respondent, the delay of 108 days in filing the above Criminal Revision Petition is condoned. __________ Page2 of 4 https://www.mhc.tn.gov.in/judis CRL MP No. 6638 of 2026 6. The Office is directed to number the Crl.R.C. immediately and list the matter ‘for admission’ on 20.07.2026.
