For Petitioner(s): Mr.P.Sam Japa Singh For Respondent(s): Mr.S.Siddhartha Vishnu, GA Order This Writ Petition has been filed seeking a direction to the respondents to consider the petitioners’ representation dated 09.03.2026 and consequently issue Legal Heir certificate of Late Thambu Measthiri mentioning Late Duraikannu as his sole legal heir based on the enquiry conducted in Na.Ka.No.2096/2020/A3 dated 26.08.2021 within a time frame fixed by this Court. 2. Learned Government Advocate for the respondents would submit that the petitioners are seeking legal heir certificate for their deceased grandfather claiming that their deceased father was the sole legal heir of their grandfather. He would further submit that the grandfather of the petitioners passed away on 23.09.1967 and hence, there may be difficulty due to long efflux of time. 3. Learned counsel for the petitioners placed on record the enquiry report, wherein, it has been recommended by the Tahsildar vide proceedings dated 26.08.2021 to consider petitioners’ request. He would also submit that there had https://www.mhc.tn.gov.in/judis WP No. 25129 of 2026 __________ Page3 of 4 been difficulty in deciding the matter in view of the considerable passage of time for want of documents and other material evidences. 4. However, learned Government Advocate for the respondents would submit that keeping in view the recommendation of the Tahsildar, the respondents would conduct enquiry and pass appropriate orders in accordance with law, provided adequate materials available on record. 5. Accordingly, this Writ Petition is disposed of. The respondents are directed to consider the representation of the petitioners dated 09.03.2026, keeping in view the recommendation made by the Tahsildar and pass appropriate orders within a period of four weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. It is open to the petitioners to place reliance upon any order of this Court in support of their request. No costs.
