This petition is filed by wife for transfer of M.C.No.1036/2023 filed by husband for restitution of conjugal rights before the II Addl.Principal Judge, Family Court, Bengaluru. Their marriage was performed on - 3 - HC-KAR NC: 2026:KHC:2858 CP No. 347 of 2023 05.08.2020 and a child was born on 17.01.2022. Petitioner stated that respondent/husband deserted her after the delivery and also not paid any maintenance to her and to the child. The distance between Bengaluru and Pavagada taluk of Tumkur District, where she is residing along with her parents is at a distance of 185 kilometers. Therefore, it is inconvenient for her to travel along with her minor child. As such she filed for transfer. 4. As there is no representation from other side, this Court finds it reasonable to transfer M.C.No.1036/2023 from the II Addl.Principal Judge, Family Court, Bengaluru to the Principal Senior Civil Judge, Pavagada.
