Mr. Imran Ali, Ms. Rita Datta. ..for the State. Memo of evidence filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. There are case and counter case regarding fight between co-villagers. No grievous injury was suffered by anyone. Arms were recovered pursuant to the leading statement of a co-accused who was in custody. he has now been granted bail. Learned counsel appearing on behalf of the State relies on the report, the case diary and opposes the prayer for anticipatory bail. He submits that the petitioners had attacked the victims with arms and other weapons. Injuries were received by one of the victims. Reliance is placed on the FIR and the statement of other witnesses including the victims. Three of the petitioners namely the petitioner nos.1, 3 and 4 have criminal antecedent of similar nature. 2 Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected.
